Cost Of Credit Disclosure Act

  • Overview: This Act regulates lending and collection activities of lenders and credit sellers. This Act requires disclosure of the cost of borrowing, and prohibits unsolicited credit cards, and provides penalties for offenders.
  • Eligibility: Any person or company that carries on the business of extending credit must submit a completed application form with copies of any contracts to be used with consumers for approval, along with the appropriate fee.

The Direct Sellers Act

  • Overview: The Direct Sellers Act requires the licensing of companies and their sales representatives to conduct door-to-door sales activities. This Act provides the consumer with a 10-day cancellation right for any direct sales contract.
  • Eligibility: Any company and its representatives that conduct door-to-door sales activities are required to license under this Act. Direct Sellers must submit the proper applications for the company and for sales representatives along with the required bond and contracts to be used with consumers for approval. See below for list of fees.
  • Description: This Act provides consumer protection by requiring direct sellers to print the Buyers' Right to Cancel on the face of the contract, in both official languages, along with specific information in relation to the product purchased. The Act authorizes the Consumer Affairs Branch to conduct investigations of complaints and to perform audits where necessary. Penalties are provided for direct sellers who do not comply with the Act.

The Pre-arranged Funeral Services Act

  • Overview:

  • Description: The Act authorizes the Branch to investigate complaints and to perform both routine and special audits.

The Real Estate Agents Act

  • Overview: The real estate industry is co-regulated by this Act and the private legislation, An Act to Incorporate the New Brunswick Real Estate Association, which is administered through the Association.
    The Association is responsible for the education and discipline of its members respecting their Code of Ethics and Standards of Business Practices. They also collect membership fees and administer local Real Estate Boards.
  • Description: An agent's license is issued to the corporate body, partnership, or individual who is legally responsible for contracts, financial accountability, advertising, and the activities of each of its salespeople. The Act provides the Branch the authority to investigate certain complaints, and to order financial audits when necessary. Penalties are provided for non-compliance.

The Collection Agencies Act

  • Overview: Many lenders/creditors hire Collection Agencies to collect past-due debts on their behalf. Any company or individual that carries on the business of collecting third-party debt is required to license under this legislation.

The Auctioneer's License Act

  • Overview: This Act requires that any person acting as an auctioneer be licensed to do so. Exceptions include persons auctioning Crown property, persons auctioning property being sold by a municipality or under the authority of a court, or goods being auctioned for religious or charitable purposes.
  • Eligibility: Applicants must complete the required form and provide a $1000 bond, as per the Act.
  • Description: The Act provides authority for suspension or cancellation of an auctioneer's license in the case of misconduct. The Act also provides procedures for bond forfeiture to cover consumer loss.
