Under sections 10, 17 and 21 of the Apprenticeship and Occupational Certification Act, the Minister makes the following Regulation:

 

1                   This Regulation may be cited as the General Regulation - Apprenticeship and Occupational Certification Act.

 

Definitions

2                   In this Regulation

 

"Act" means the Apprenticeship and Occupational Certification Act.

 

OCCUPATIONS

Designated occupations

3                   Each occupation in Schedule A is prescribed as a designated occupation.

 

Compulsory occupations

4                   Each designated occupation in Schedule B is prescribed as a compulsory occupation.

 

Scope of designated occupations

5                   The scope of a designated occupation shall be as set out in Schedule C for the designated occupation.

 

APPRENTICESHIP

Qualifications for apprenticeship

6(1)              No person shall be registered as an apprentice in a designated occupation unless the person has the qualifications necessary for apprenticeship in the designated occupation as set out in Schedule C.

 

6(2)              In addition to the qualifications set out in Schedule C, the Director may require from a person applying to be registered as an apprentice in a designated occupation proof that that person has successfully completed any course, test, examination or training considered necessary for apprenticeship in the designated occupation by the Director.

 

6(3)              The Director may require from a person applying to be registered as an apprentice in a designated occupation such information as the Director may consider necessary to ensure that that person has the qualifications necessary for apprenticeship in the designated occupation.

 

Candidate for diploma of apprenticeship

7                   A candidate for a diploma of apprenticeship in a designated occupation shall

 

(a)          complete to the satisfaction of the Director the plan of apprenticeship approved for the designated occupation and successfully pass the examination for the diploma of apprenticeship,

 

(b)          successfully complete the program of study, including any course, test, examination and training provided for, or otherwise required of, an apprentice in the designated occupation, and

 

(c)           when requested by the Director supply documentary evidence satisfactory to the Director of the successful completion or passing of the requirements referred to in paragraphs (a) and (b).

 

Apprentice

8                   An apprentice shall

 

(a)          attend the technical training required of the apprentice in the designated occupation and provide to the Director satisfactory reasons for any absence,

 

(b)          for the purpose of on-the-job training and work experience attend the place of work of the employer during the established hours of work, and provide to the employer satisfactory reasons for any absence,

 

(c)           show due regard for the property of the employer and avoid damage and waste of that property, and

 

(d)          obey all lawful orders given by the employer or any person designated by the employer to supervise the on-the-job training and work experience of the apprentice.

 

Apprenticeship agreement

9(1)              Where an apprenticeship agreement is entered into between an apprentice and an employer, the employer shall

 

(a)          provide to the apprentice satisfactory on-the-job training and work experience as set out in the progress record book for the designated occupation to the extent the facilities of the employer and the character of the work will permit,

 

(b)          when requested by the Director, review and update the progress record book of the apprentice,

 

(c)           permit and encourage the apprentice to attend the technical training as set out in the curriculum plan for the designated occupation, and

 

(d)          retain the apprentice over another apprentice with less seniority in the case of a lay-off.

 

9(2)              Where an apprenticeship agreement is entered into between an apprentice and a joint apprenticeship training committee, the joint apprenticeship training committee shall

 

(a)          ensure satisfactory on-the-job training and work experience as set out in the progress record book for the designated occupation are made available to the apprentice on a reasonably continual basis,

 

(b)          when requested by the Director, review and update the progress record book of the apprentice, and

 

(c)           ensure the apprentice attends the technical training as set out in the curriculum plan for the designated occupation.

 

9(3)              An apprenticeship agreement shall remain in effect for no less than the number of years set out in Schedule C for the designated occupation.

 

Transfer of apprenticeship agreement

10(1)            Where an apprenticeship agreement is transferred from an employer to another employer or a joint apprenticeship training committee, the employer or joint apprenticeship training committee to whom the apprenticeship agreement is transferred shall abide by the terms and conditions of the original apprenticeship agreement.

 

10(2)            Where an apprenticeship agreement is transferred from a joint apprenticeship training committee to another joint apprenticeship training committee or an employer, the joint apprenticeship training committee or employer to whom the apprenticeship agreement is transferred shall abide by the terms and conditions of the original apprenticeship agreement.

 

Employment of apprentice

11(1)            Except as otherwise provided in a collective agreement binding on the employer, an employer who employs one journeyperson in a designated occupation, or an employer who is a journeyperson working in a designated occupation, may employ one apprentice in that designated occupation and one additional apprentice in the designated occupation for each additional journeyperson employed in the designated occupation.

 

11(2)            An employer shall ensure that for each apprentice employed by the employer in a designated occupation, there is a journeyperson in that designated occupation who is available to supervise the apprentice.

 

11(3)            Notwithstanding subsections (1) and (2) but subject to the provisions of a collective agreement binding on the employer, the Director may authorize an employer to employ an apprentice, or additional apprentices, as warranted by the circumstances.

 

Apprenticeship year

12(1)            Each year of apprenticeship shall consist of

 

(a)          a maximum of eighteen hundred hours of on-the-job training and work experience as set out in the progress record book for the designated occupation, and

 

(b)          related technical training as set out in the curriculum plan for the designated occupation.

 

12(2)            Time spent attending related technical training may, at the discretion of the Director, be included in the calculation of the eighteen hundred hours under paragraph (1)(a).

Hours of work

13(1)            The regular daily hours of on-the-job training and work experience of an apprentice shall coincide with the regular daily working hours of the journeyperson with whom the apprentice is working, and the total time spent by an apprentice in on-the-job training and work experience in any week shall exceed the total hours spent by the apprentice in any other form of employment in that week.

 

13(2)            Hours worked by an apprentice in excess of the regular daily hours of on-the-job training and work experience shall not be included in computing the time spent in on-the-job training and work experience, unless approved by the Director.

 

Wages

13.1(1)         Notwithstanding the Minimum Wage for Categories of Employees in Crown Construction Work Regulation - Employment Standards Act, unless otherwise established as part of a collective agreement, the rate of wages for an apprentice whether for regular daily hours of work or for hours in excess of regular daily hours of work shall not be less than

 

(a)          where the period of apprenticeship is one year,

 

(i)       fifty per cent during the first nine hundred hours, and

 

(ii)      sixty-five per cent during the second nine hundred hours,

 

(b)          where the period of apprenticeship is two years,

 

(i)       fifty per cent during the first nine hundred hours,

 

(ii)      sixty per cent during the second nine hundred hours,

 

(iii)     seventy per cent during the third nine hundred hours, and

 

(iv)     eighty per cent during the fourth nine hundred hours,

 

(c)           where the period of apprenticeship is three years,

 

(i)       fifty per cent during the first nine hundred hours,

 

(ii)      fifty-five per cent during the second nine hundred hours,

 

(iii)     sixty per cent during the third nine hundred hours,

 

(iv)     sixty-five per cent during the fourth nine hundred hours,

 

(v)      seventy per cent during the fifth nine hundred hours, and

 

(vi)     eighty-five per cent during the sixth nine hundred hours,

 

(d)          where the period of apprenticeship is four years,

 

(i)       fifty per cent during the first nine hundred hours,

 

(ii)      fifty-five per cent during the second nine hundred hours,

 

(iii)     sixty per cent during the third nine hundred hours,

 

(iv)     sixty-five per cent during the fourth nine hundred hours,

 

(v)      seventy per cent during the fifth nine hundred hours,

 

(vi)     seventy-five per cent during the sixth nine hundred hours,

 

(vii)    eighty per cent during the seventh nine hundred hours, and

 

(viii)   eighty-five per cent during the eighth nine hundred hours, and

 

(e)           where the period of apprenticeship is five years,

 

(i)            fifty per cent during the first nine hundred hours,

 

(ii)      fifty-five per cent during the second nine hundred hours,

 

(iii)     sixty per cent during the third nine hundred hours,

 

(iv)     sixty-five per cent during the fourth nine hundred hours,

 

(v)      seventy per cent during the fifth nine hundred hours,

 

(vi)     seventy-five per cent during the sixth nine hundred hours,

 

(vii)    eighty per cent during the seventh nine hundred hours,

 

(viii)   eighty per cent during the eighth nine hundred hours,

 

(ix)     eighty-five per cent during the ninth nine hundred hours, and

 

(x)      eighty-five per cent during the tenth nine hundred hours,

 

of the average hourly rate of wages for journeypersons employed by the employer in the designated occupation or, where the employer is the only journeyperson employed, of the average hourly rate of wages for journeypersons in the area.

 

13.1(2)         Notwithstanding subsection (1), in cases where provisions of the Minimum Wage Regulation - Employment Standards Act require the payment of a higher rate of wages than a rate established in subsection (1), the provisions of the Minimum Wage Regulation - Employment Standards Act shall apply.

Credits

14(1)            A person who, before entry into the apprenticeship program in relation to which an apprenticeship agreement is entered into, gained on-the-job training, work experience or related technical training in the designated occupation or an allied occupation, may apply to the Director to have the on-the-job training, work experience or related technical training credited towards the plan of apprenticeship approved for the designated occupation.

 

14(2)            Where the Director receives an application under subsection (1), the Director may grant credits for prior on-the-job training, work experience or related technical training towards the plan of apprenticeship approved for the designated occupation.

 

14(3)            In determining whether to grant credits, the Director shall consider

 

(a)          the on-the-job training and work experience in the designated occupation or an allied occupation gained by the applicant before entry into the apprenticeship program,

 

(b)          the nature and quality of any related technical training previously completed or any related examination previously passed,

 

(c)           the standard achieved by the applicant in the technical training or on the examination referred to in paragraph (b), and

 

(d)          the recommendation of the employer or joint apprenticeship training committee with whom the apprentice has entered into an apprenticeship agreement.

 

Examinations

15(1)            The examination for a diploma of apprenticeship in a designated occupation shall be provided by the Director.

 

15(2)            The Director shall determine the mark required to successfully pass the examination for a diploma of apprenticeship in a designated occupation.

 

15(3)            Where a candidate for a diploma of apprenticeship in a designated occupation has failed to successfully pass the examination for the diploma of apprenticeship, the candidate may be re-examined at such time and under such conditions as may be determined by the Director.

 

Diploma of apprenticeship

16(1)            Where an apprentice has successfully completed a plan of apprenticeship for a designated occupation and has successfully passed the examination for a diploma of apprenticeship in the designated occupation, the Board shall issue a diploma of apprenticeship to the apprentice.

 

16(2)            A diploma of apprenticeship remains valid unless suspended or cancelled by the Director.

 

16(3)            A person whose diploma of apprenticeship has been cancelled may apply to the Board for a new diploma of apprenticeship.

 

16(4)            The Board may issue a new diploma of apprenticeship to a person whose diploma of apprenticeship has been cancelled where it is satisfied that the person

 

(a)          has fully remedied the circumstances that gave rise to the cancellation, and

 

(b)          has the capacity and competence to perform work in the designated occupation.

 

16(5)            The Board may require a person applying for a new diploma of apprenticeship under subsection (3) to take and complete additional on-the-job training, work experience or related technical training or successfully pass the examination for the diploma of apprenticeship before issuing a new diploma of apprenticeship.

 

Form of apprenticeship agreement

17                 An apprenticeship agreement shall be on a form provided by the Director.

 

Form of transfer of apprenticeship agreement

18                 A transfer of an apprenticeship agreement shall be on a form provided by the Director.

 

Form of diploma of apprenticeship

19                 A diploma of apprenticeship shall be on a form provided by the Director.

 

CERTIFICATION

Requirements of candidates

20                 No person shall be a candidate for a certificate of qualification in a designated occupation unless the person fulfils the requirements of a candidate for a certificate of qualification in the designated occupation as set out in Schedule C.

 

Work experience

21(1)            The number of hours that can be counted towards work experience for a certificate of qualification in a designated occupation shall not exceed eighteen hundred hours during a twelve month period.

 

21(2)            Work experience in a designated occupation not gained while performing activities for which the person is normally employed shall not be counted towards work experience for a certificate of qualification in the designated occupation.

 

21(3)            The Director may establish any guideline or policy the Director considers necessary to ensure work experience for a certificate of qualification in a designated occupation is gained in accordance with subsections (1) and (2).

 

Examinations

22(1)            The examination for a certificate of qualification in a designated occupation shall be compiled by the Director after consultation with representatives of the industry.

 

22(2)            The examination of a candidate for a certificate of qualification in a designated occupation and the requirements to be met to successfully pass such examination shall be as set out in Schedule C for the designated occupation.

 

22(3)            An approved reader or interpreter may be used by a candidate for a certificate of qualification in a designated occupation to assist the candidate in completing the examination for the certificate of qualification and shall be supplied by the candidate.

 

22(4)            An approved reader or interpreter shall be a person with no familiarity with the occupation, or an allied occupation, for which the candidate is being examined and who is suitable in all other respects to the Director.

 

22(5)            Except as otherwise provided in Schedule C, where a candidate for a certificate of qualification in a designated occupation has failed to successfully pass the examination for the certificate of qualification, the candidate may be re-examined at such time and under such conditions as may be determined by the Director.

 

Certificate of qualification

23(1)            A certificate of qualification remains valid unless suspended or cancelled by the Director.

 

23(2)            A person whose certificate of qualification has been cancelled may apply to the Board for a new certificate of qualification.

 

23(3)            The Board may issue a new certificate of qualification to a person whose certificate of qualification has been cancelled where it is satisfied that the person

 

(a)          has fully remedied the circumstances that gave rise to the cancellation, and

 

(b)          has the capacity and competence to perform work in the designated occupation.

 

23(4)            The Board may require a person applying for a new certificate of qualification under subsection (2) to take and successfully complete the apprenticeship program or to successfully pass the examination for the certificate of qualification before issuing a new certificate of qualification.

 

Form of application for certificate of qualification

24                 An application for a certificate of qualification shall be on a form provided by the Director.

25                 A certificate of qualification shall be on a form provided by the Director.

 

LETTER OF AUTHENTICITY

Issuance of letter of authenticity

26(1)            No person shall be issued a letter of authenticity in a designated occupation unless the person

 

(a)          completes and files with the Director the application for a letter of authenticity,

 

(b)          proves to the satisfaction of the Director that the person meets the requirements as to work experience and practice established by the Board for a letter of authenticity in the designated occupation, and

 

(c)           pays the fee set out in paragraph 32(g).

 

26(2)            A letter of authenticity remains valid unless suspended or cancelled by the Director.

 

26(3)            A person whose letter of authenticity has been cancelled may apply to the Board for a new letter of authenticity.

 

26(4)            The Board may issue a new letter of authenticity to a person whose letter of authenticity has been cancelled where it is satisfied that the person

 

(a)          has fully remedied the circumstances that gave rise to the cancellation, and

 

(b)          has the capacity and competence to perform work in the designated occupation.

 

Form of application for letter of authenticity

27                 An application for a letter of authenticity shall be on a form provided by the Director.

 

Form of letter of authenticity

28                 A letter of authenticity shall be on a form provided by the Director.

 

GENERAL

Replacement diploma, certificate or letter

29                 The Board may provide a replacement diploma of apprenticeship, certificate of qualification or letter of authenticity to a person who submits to the Board an affidavit, on a form provided by the Director, and who proves to the satisfaction of the Board that the diploma, certificate or letter, as the case may be, has been lost or destroyed.

 

Form of joint application for work permit

30                 A joint application for a work permit under subsection 18(1) of the Act shall be on a form provided by the Director.

 

Form of work permit

31                 A permit to continue to work under subsection 18(1) of the Act shall be on a form provided by the Director.

 

Fees

32                 Payment of the following fees is required:

(a)          for a written examination of a candidate for a certificate of qualification in a designated occupation      

$250.00;

 

 

(b)          for a re-examination of an examination referred to in paragraph (a)    

$50.00;

    

 

     (c)     for a practical examination of a candidate for a certificate of qualification in a designated occupation

     (e)     for a written examination of a holder of a diploma of apprenticeship for the purpose of obtaining a Canadian Inter-Provincial Standards Examination Seal

     (f)      for the issuance of a certificate of qualification in a designated occupation under subparagraph 10(1)(b)(iii), (iv) or (v) of the Act 

$25.00;

    

 

     (g)     for the issuance of a letter of authenticity

$200.00;

    

 

   

(h)     for the issuance of a permit to continue to work in a compulsory occupation     

$100.00; and

 

 

(i) for the issuance of a replacement diploma of apprenticeship, a replacement certificate of qualification or a replacement letter of authenticity  

$10.00.

 

 

Commencement

33                 This Regulation comes into force on November 10, 1997.

(d)          the repairing, maintenance and servicing of brakes, steering, suspension, wheels, tires, tubes and related assemblies;

 

(e)           the repairing, maintenance and servicing of clutches, torque converters, transmissions, axles, differentials, drive lines and related assemblies;

 

(f)            the repairing, maintenance and servicing of agricultural machinery and implements;

 

(g)          the repairing, maintenance and servicing of hydraulic, mechanical and air machine systems and related assemblies;

 

(h)          the use of arc and gas welding equipment; and

(c)           is willing to enter into an apprenticeship agreement in the agricultural equipment technician occupation with an employer or a joint apprenticeship training committee.

(a)          the installation, servicing and repairing of domestic refrigerators, freezers, electric ranges, microwave ovens, clothes washers and dryers, dishwashers, room air conditioners, dehumidifiers, garbage disposal units, compactors and vacuum cleaning systems;

 

(b)          the diagnosing of faults, the adjusting of component parts, the replacing or repairing of defective parts and the evacuating and recharging of domestic refrigeration systems; and

 

(c)           the reclaiming, recovering, recycling and reusing of ozone depleting substances.

 

Qualifications for apprenticeship

1(2)              No person shall be registered as an apprentice in the appliance service technician occupation unless the person

 

(a)          has successfully passed Grade 10 or its equivalent as determined by the Board,

 

(b)          is physically able to perform all of the duties of the appliance service technician occupation, and

 

(c)           is willing to enter into an apprenticeship agreement in the appliance service technician occupation with an employer or a joint apprenticeship training committee.

 

Duration of apprenticeship agreement

1(3)              An apprenticeship agreement in the appliance service technician occupation shall remain in effect for the equivalent of a minimum of three years.

(a)          the preparing of metal surfaces for painting;

 

(b)          the application of primers, surfacers, enamels and lacquers;

 

(c)           the cleaning and polishing of painted surfaces;

 

(d)          the cleaning of upholstery; and

 

(e)           the removing and replacing of decals.

 

Qualifications for apprenticeship

2(2)              No person shall be registered as an apprentice in the automotive painter occupation unless the person

 

(a)          has successfully passed Grade 12 or its equivalent as determined by the Board,

 

(b)          is physically able to perform all of the duties of the automotive painter occupation, and

 

(c)           is willing to enter into an apprenticeship agreement in the automotive painter occupation with an employer or a joint apprenticeship training committee.

 

Duration of apprenticeship agreement

2(3)              An apprenticeship agreement in the automotive painter occupation shall remain in effect for the equivalent of a minimum of two years.

(d)          the removing and replacing of trim panels, seat covers and head linings;

 

(e)           the removing and replacing of door and window hardware;

 

(f)            the removing and replacing of bumpers, grilles, mouldings and decals;

 

(g)          the use of soldering and welding equipment;

 

(h)          the application of hot or cold body fillers; and

 

(i)           the preparing of metal surfaces for painting.

 

Qualifications for apprenticeship

3(2)              No person shall be registered as an apprentice in the automotive repairer occupation unless the person

 

(a)          has successfully passed Grade 12 or its equivalent as determined by the Board,

 

(b)          is physically able to perform all of the duties of the automotive repairer occupation, and

 

(c)           is willing to enter into an apprenticeship agreement in the automotive repairer occupation with an employer or a joint apprenticeship training committee.

(b)          the use of wheel alignment equipment to perform two and four wheel alignment on automobiles and light trucks; and

 

(c)           the performing of inspections on automobiles and light trucks in accordance with the Motor Vehicle Act.

 

Qualifications for apprenticeship

6(2)              No person shall be registered as an apprentice in the automotive service technician (steering, suspension and brakes) occupation unless the person

 

(a)          has successfully passed Grade 12 or its equivalent as determined by the Board,

 

(b)          is physically able to perform all of the duties of the automotive service technician (steering, suspension and brakes) occupation, and

 

(c)           is willing to enter into an apprenticeship agreement in the automotive service technician (steering, suspension and brakes) occupation with an employer or a joint apprenticeship training committee.

 

Duration of apprenticeship agreement

6(3)              An apprenticeship agreement in the automotive service technician (steering, suspension and brakes) occupation shall remain in effect for the equivalent of a minimum of three years.

(d)          the application of a knowledge of the Acts and regulations pertaining to the food industry;

 

(e)           the selecting, operating and maintenance of tools and non-mechanized equipment;

 

(f)            the selecting, operating and maintenance of mechanized and computerized equipment;

 

(g)          the developing and application of production techniques respecting

 

(i)       freezer technology;

          

(ii)      pre-baked products; and

 

(iii)     pre-mixes and bases;

 

(h)          the preparing of doughs and batters;

 

(i)           the preparing of creams, icings, fillings, toppings, desserts, confections and ice cream;

 

(j)            the application of good management techniques;

 

(k)          the scaling and mixing of ingredients;

 

(l)           the practising of baking methods;

 

(m)          the application of one's knowledge with respect to

 

(i)       properties of food;

 

(ii)      micro-organisms associated with foods;

 

(iii)     causes, effect and control of food borne illnesses; and

 

(iv)     nutrients; and

 

(n)          the labelling of products.

 

Requirements of candidates for certificates of qualification

8(2)              No person shall be a candidate for a certificate of qualification in the baker occupation unless the person

 

(a)                completes and files with the Director the application provided by the Director,

 

(b)          proves to the satisfaction of the Director that experience has been gained equivalent to four years of practical experience in the baker occupation, and

 

(c)           pays the fee for the examination for the certificate of qualification.

8(3)              The examination for a certificate of qualification in the baker occupation shall be a written examination.

BLASTER OCCUPATION

Scope of the occupation

10(1)            The blaster occupation includes

 

(a)          the drilling in preparation for blasting operations;

 

(b)          the mixing of blasting agents on-site and the assembling, placing and detonating of charges of explosives to loosen or break earth, rock, stumps and ice or to demolish structures and otherwise prepare all blasting operations on the surface or under water;

 

(c)           the examining of the mass, composition, structure and location of the material to be blasted;

 

(d)          the estimating of the amount and type of explosive to be used;

 

(e)           the making and maintaining of blast and inventory records; and

 

(f)            having the direct responsibility for all phases of the blaster occupation referred to in paragraphs (a) to (e), as well as the transporting and storing of all explosive materials on-site in accordance with the Explosives Act (Canada), the Occupational Health and Safety Act and the Transportation of Dangerous Goods Act and the regulations made under those Acts.

 

Categories of certification

10(2)            The categories of certification for the blaster occupation and their limitations are as follows:

 

(a)          Category 1 - the holder of a Category 1 certificate of qualification is authorized to supervise and perform surface and underwater blasting operations with no limitations;

 

(b)          Category 2 - the holder of a Category 2 certificate of qualification is authorized to supervise and perform surface and underwater blasting operations

 

(i)       if under the supervision of the holder of a Category 1 certificate of qualification or under the control of a professional blasting engineer, with no limitations, or

 

(ii)      if unsupervised, limited to a scale distance of 60 (imperial) and 22.7 (metric);

 

(c)           Category 3 - the holder of a Category 3 certificate of qualification is authorized to supervise and perform surface and underwater blasting operations with the following limitations:

 

(i)       if supervised, to the limitations of the certificate of qualification of the supervisor; or

 

(ii)      if unsupervised, limited to a maximum of 250 kg (550 lbs) of explosive per shot and to a scale distance of 60 (imperial) and 22.7 (metric); and

 

(d)     Category M - the holder of a Category M certificate of qualification is authorized to supervise and perform blasting operations in a smelter operation and is limited to a maximum of 10 kg (22 lbs) of explosive per shot.

 

Requirements of candidates for certificates of qualification

10(3)            No person shall be a candidate for a certificate of qualification in any category of certification of the blaster occupation unless the person

 

(a)          completes and files with the Director the application provided by the Director and information detailing the experience of the candidate for the certificate of qualification by means of a letter specifying actual blast experience, date of commencement of employment, duration of employment and other related information, from the employer or the blaster in charge or by an affidavit from the candidate for the certificate of qualification if the employer or the blaster in charge cannot be located,

 

(b)          is eighteen years of age or over at the time of application,    

 

(c)           proves to the satisfaction of the Director that a thorough knowledge has been gained of the properties, care, use, storage and transportation of explosives,

 

(d)          meets the requirements for the category of certification in question, and

 

(e)           pays the fee for the examination for the certificate of qualification.

 

10(4)            The requirements for each category of certification of the blaster occupation are as follows:

 

(a)                for Category 1, the candidate shall

 

(i)       be the holder of a Category 2 certificate of qualification, and

 

(ii)      prove to the Director by the same means as provided under paragraph (3)(a) that the candidate has performed at least fifteen hundred hours of work in blasting operations after obtaining the Category 2 certificate of qualification;

 

(b)          for Category 2, the candidate shall

 

(i)       be the holder of a Category 3 certificate of qualification,

 

(ii)      prove to the Director by the same means as provided under paragraph (3)(a) that the candidate has performed at least fifteen hundred hours of work in blasting operations after obtaining the Category 3 certificate of qualification, and

 

(iii)     successfully pass the examination for the Category 2 certificate of qualification under this section;

 

(c)           for Category 3, the candidate shall

 

(i)       prove to the Director by the same means as provided under paragraph (3)(a) that the candidate has performed at least one thousand hours of supervised work in blasting operations, and

 

(ii)      successfully pass the examination for the Category 3 certificate of qualification under this section; and

 

(d)          for Category M, the candidate shall

 

(i)       prove to the Director by the same means as provided under paragraph (3)(a) that the candidate has performed at least one thousand hours of supervised work in blasting operations in a smelter operation, and

 

(ii)      successfully pass the examination for the Category M certificate of qualification under this section.

 

10(5)            The experience of a candidate in obtaining a Category S certificate of qualification under New Brunswick Regulation 93-1 under the Act, as it existed before the commencement of this Regulation, or a Category M certificate of qualification under this section shall not be counted when applying for any other certificate of qualification in the blaster occupation.

 

Examinations

10(6)            The examination for a Category 2, Category 3 or Category M certificate of qualification in the blaster occupation shall consist of a written phase and a practical phase.

 

10(7)            The practical phase shall be conducted by a qualified examiner appointed under the Act, who shall hold a valid certificate of qualification in the blaster occupation equal to or higher than the category in which the examination is being conducted.

 

10(8)            The mark required to successfully pass the examination is seventy-five per cent on each phase.

 

10(9)            If a candidate fails one phase of the examination, that phase of the examination may be reattempted, and the results obtained in the other phase of the examination shall be considered valid for a period of two years towards successful completion of the examination, if the candidate still meets the application requirements for the category.

 

10(10)          If a candidate fails one or more sections of the practical phase of the examination, all sections shall be reattempted in order for the candidate to successfully pass that phase of the examination.

 

Transition

10(11)          A person who on the commencement of this subsection holds a valid Category 1 certificate of qualification in the blaster occupation shall be deemed to be the holder of a Category 1 certificate of qualification in the blaster occupation under this Regulation.

 

10(12)          A person who on the commencement of this subsection holds a valid Category 2 certificate of qualification in the blaster occupation shall be deemed to be the holder of a Category 2 certificate of qualification in the blaster occupation under this Regulation.

 

10(13)          A person who on the commencement of this subsection holds a valid Category 3 certificate of qualification in the blaster occupation shall be deemed to be the holder of a Category 3 certificate of qualification in the blaster occupation under this Regulation.

 

10(14)          A person who on the commencement of this subsection holds any other valid certificate of qualification in the blaster occupation may continue to operate in accordance with the limitations of that certificate as they existed immediately before the commencement of this subsection.

 

BRICKLAYER OCCUPATION

Scope of the occupation

11(1)            The bricklayer occupation includes

 

(a)          the laying of bricks, concrete blocks, tiles and other building materials and the construction or repairing of walls, partitions, arches, fireplaces and other structures;

 

(b)          the measuring of distances from reference points and the marking of guidelines on the working surface to lay the work;

 

(c)           the laying of brick in horizontal rows or in designs or shapes and the spreading of mortar with a trowel to imbed them;

 

(d)          the determining of vertical and horizontal alignment courses as the work progresses, using plumb line and level; and

 

(e)           the fastening of brick or terra cotta veneer to the face of structures.

 

Qualifications for apprenticeship

11(2)            No person shall be registered as an apprentice in the bricklayer occupation unless the person

 

(a)          has successfully passed Grade 12 or its equivalent as determined by the Board,

 

(b)          is physically able to perform all of the duties of the bricklayer occupation, and

 

(c)           is willing to enter into an apprenticeship agreement in the bricklayer occupation with an employer or a joint apprenticeship training committee.

 

Duration of apprenticeship agreement

11(3)            An apprenticeship agreement in the bricklayer occupation shall remain in effect for the equivalent of a minimum of three years.

 

Requirements of candidates for certificates of qualification

11(4)            No person shall be a candidate for a certificate of qualification in the bricklayer occupation unless the person

 

(a)          completes and files with the Director the application provided by the Director,

 

(b)          proves to the satisfaction of the Director that experience has been gained equivalent to four years of practical experience in the bricklayer occupation or that the person has successfully completed an apprenticeship program in that occupation under the Act, and

 

(c)           pays the fee for the examination for the certificate of qualification.

11(5)            The examination for a certificate of qualification in the bricklayer occupation shall be a written examination.

 

11(6)            The mark required to successfully pass the examination is

 

(a)          where the examination is conducted before January 1, 1998, sixty-five per cent, and

CABINETMAKER OCCUPATION

Scope of the occupation

12(1)            The cabinetmaker occupation includes

 

(a)          the construction and repairing of wooden articles using woodworking machines and hand tools;

 

(b)          the studying of blueprints or drawings of articles to be made;

 

(c)           the marking of outlines or dimensions of parts on paper or lumber stock;

 

(d)          the matching of materials for colour, grain or texture;

 

(e)           the setting up and operating of woodworking machines, including power saws, jointers, mortisers, tenoners, moulders and shapers, to cut and shape parts from stock;

 

(f)            the forming of component parts of joints to make them fit snugly, boring holes for insertion of screws or dowels;

 

(g)          the gluing, fitting and clamping of parts and subassemblies together to form complete units;

 

(h)          the driving of nails and other fasteners into joints to reinforce them and the sanding and scraping of surfaces to prepare them for finishing;

 

(i)           the coating of assembled articles with materials such as stains, varnishes or paint by dipping, brushing or spraying; and

 

(j)            the installation of hardware such as hinges, catches and drawer pulls.

 

Qualifications for apprenticeship

12(2)            No person shall be registered as an apprentice in the cabinetmaker occupation unless the person

 

(a)          has successfully passed Grade 12 or its equivalent as determined by the Board,

 

(b)          is physically able to perform all of the duties of the cabinetmaker occupation, and

 

(c)           is willing to enter into an apprenticeship agreement in the cabinetmaker occupation with an employer or a joint apprenticeship training committee.

 

Duration of apprenticeship agreement

12(4)            No person shall be a candidate for a certificate of qualification in the cabinetmaker occupation unless the person

 

(a)          completes and files with the Director the application provided by the Director,

 

(b)          proves to the satisfaction of the Director that experience has been gained equivalent to five years of practical experience in the cabinetmaker occupation or that the person has successfully completed an apprenticeship program in that occupation under the Act, and

 

(c)           pays the fee for the examination for the certificate of qualification.

12(5)            The examination for a certificate of qualification in the cabinetmaker occupation shall be a written examination.

 

12(6)            The mark required to successfully pass the examination is

 

(a)          where the examination is conducted before January 1, 1998, sixty-five per cent, and

 

(b)          where the examination is conducted on or after January 1, 1998, seventy per cent.

 

CARPENTER OCCUPATION

Scope of the occupation

13(1)            The carpenter occupation includes

 

(a)          the joining, assembling, erection, shoring, installation, dismantling and repairing of wood, wood substitutes or metal items;

 

(b)          the burning, tack welding, rigging and scaffolding of materials used in connection with the carpenter occupation;

 

(c)           the use of tools or instruments for layout work related to the carpenter occupation; and

 

(d)          the interpreting of blueprints, sketches and plans relating to any phase of the carpenter occupation.

 

13(2)       The operations referred to in paragraphs (1)(a) to (d) apply to:

 

(a)          concrete forms for footings, walls, piers, columns, slabs, stairs, roads, walkways and curbing, together with their associated ties, shoring and bracing;

 

(b)          framing, sheathing and finish in buildings for the construction of walls, ceilings, floors, roofs and stairs;

 

(c)           fly screens, door and window frames, doors, windows, sills, curtain walls, clapboard, aluminium or composition siding, shingles and vitrified tiles, as well as weatherstripping and caulking used in connection therewith;

 

(d)          metal partitions, including those that are folding or moveable;

 

(e)           insulating substances, including those that are nailed, stapled or glued;

 

(f)            wallboards and panels of gypsum, wood, metal or composition;

 

(g)          steel studding, metal corner beads and mouldings;

 

(h)          cupboards, cabinets, counters and shelving, whether movable or immovable, and plastic laminates or other coverings used in connection therewith;

 

(i)           acoustical tiles and wallboards and mouldings used in connection therewith; and

 

(j)            scaffolding.

 

Qualifications for apprenticeship

13(3)            No person shall be registered as an apprentice in the carpenter occupation unless the person

 

(a)          has successfully passed Grade 12 or its equivalent as determined by the Board,

 

(b)          is physically able to perform all of the duties of the carpenter occupation, and

 

(c)           is willing to enter into an apprenticeship agreement in the carpenter occupation with an employer or a joint apprenticeship training committee.

15(1)            The commercial trailer technician occupation includes

 

(a)          the interpreting and use of service manuals, work reports and blueprints;

 

(b)          the use of shop tools and equipment;

 

(c)           the inspecting, removing, repairing and replacing of brake systems, electrical systems and suspension systems, including bogies, axles, wheels, tires and rims, of truck trailers and bulk carriers;

 

(d)          the inspecting, removing, repairing and replacing of components of truck trailers and bulk carriers and the realigning of frames and axles;

 

(e)           the inspecting, removing, repairing and replacing of appurtenances to a truck trailer or bulk carrier, including tow bars, hitches, turntables, fifth-wheel assemblies, landing gears and upper couplers;

 

(f)            the inspecting, testing, adjusting, removing, repairing and replacing of all safety and emergency related equipment pertaining to truck trailers and bulk carriers;

 

(g)          the ability to identify all hazards related to the commercial trailer technician occupation; and

 

(h)          the performing of the skills or functions mentioned in paragraphs (b) to (g) in a safe and acceptable manner.

15(2)            No person shall be registered as an apprentice in the commercial trailer technician occupation unless the person

16(1)            The construction boilermaker occupation includes the laying out, burning, shearing, sawing, cutting, punching, drilling, reaming, boring, tapping, threading, riveting, caulking, bolting, connecting, fastening, welding, gouging, shaping, fitting, handling and rigging of structural members, plates and tubes in the fabrication, erection, repair and maintenance of all manner of dust, air, gas, steam, oil, water or other liquid containers, structures and equipment.

16(2)            No person shall be registered as an apprentice in the construction boilermaker occupation unless the person

 

(a)          has successfully passed Grade 12 or its equivalent as determined by the Board,

 

(b)          is physically able to perform all of the duties of the construction boilermaker occupation, and

 

(c)           is willing to enter into an apprenticeship agreement in the construction boilermaker occupation with an employer or a joint apprenticeship training committee.

(a)          the installation and maintenance of electrical wiring systems and related equipment in residential, commercial and industrial establishments and other structures;

 

(b)          the planning, execution and completion of wiring systems according to applicable codes, statutes, regulations, blueprints, specifications and other requirements of any governmental or other authority having jurisdiction;

 

(c)           the installation, testing and energizing of load centres, panelboards, distribution boards, switchboards, sub-stations, switchgear, transformers and related protective devices required to ensure the integrity and safety of a wiring system;

 

(d)          the installation and energizing of any wiring method acceptable under the code and regulations in force at the time of installation along with the terminating of the necessary conductors required to complete the wiring system of any establishment or structure;

 

(e)           the installation, testing, energizing and maintenance of input and signal devices required to operate controllers or other operating devices involved with an automatic process system;

 

(f)            the installation, testing, energizing and maintenance of motors, motor starters, motor controllers and motor protective devices;

 

(g)          the installation, testing, energizing and maintenance of electrical emergency standby systems and interrelated control devices; and

 

(h)          the installation, testing, energizing and maintenance of fire alarm systems, communication systems, intrusion alarm systems and other life safety and property protection systems.

17(2)            No person shall be registered as an apprentice in the construction electrician occupation unless the person

 

(a)          has successfully passed Grade 12 or its equivalent as determined by the Board,

CONSTRUCTION LINEMAN OCCUPATION

Scope of the occupation

18(1)            The construction lineman occupation includes

 

(a)          the construction, maintenance and rebuilding of power and communication lines and related equipment in close proximity or adjacent to existing lines both overhead and underground;

 

(b)          the operating of vehicles such as trucks, all-terrain vehicles, snowmobiles and associated equipment;

 

(c)           the maintaining of a working knowledge of operating regulations, working clearances, construction standards and safety regulations;

 

(d)          the transporting and locating of heavy equipment and line apparatus;

 

(e)           the construction of sub-stations and terminals and the installation of related equipment;

 

(f)            the inspecting, commissioning, de-energizing, troubleshooting, operating and maintenance of transmission lines and related equipment both overhead and underground during normal and emergency conditions;

 

(g)          the performing of specialized hot line methods, such as the stick method and bare hand method, on transmission systems;

 

(h)          the making of operating decisions;

 

(i)           the performing of routine and emergency switching operations on transmission systems;

 

(j)            the operating and maintenance of tools and equipment associated with the construction lineman occupation;

 

(k)          the development of good customer relations;

 

(l)           the performing of routine switching operations on distribution transformers; and

 

(m)          the performing of distribution switching operations under the direct supervision of qualified personnel.

18(2)            No person shall be registered as an apprentice in the construction lineman occupation unless the person

 

(a)          has successfully passed Grade 12 or its equivalent as determined by the Board,

Scope of the occupation

19(1)            The cook occupation includes

 

(a)          the preparing, cooking and making ready for serving of foodstuffs for consumption in restaurants, dining areas in hotels or motels, institutions and similar eating areas;

 

(b)          the requisitioning, receiving and storing of food and ancillary items;

 

(c)           the operating and cleaning of electrical, steam and gas powered kitchen equipment;

 

(d)          the use, cleaning and maintenance of kitchen smallwares;

 

(e)           the use and converting of recipes and formulas relating to the cook occupation; and

 

(f)            the maintaining of an acceptable standard of sanitation and personal hygiene.

 

19(2)            Items relating to the cook occupation include

 

(a)                portion control and food cost;

 

(b)                inventory systems;

 

(c)           various methods of serving food; and

 

(d)          dish and pot washing methods.

 

Qualifications for apprenticeship

19(3)            No person shall be registered as an apprentice in the cook occupation unless the person

 

(a)          has successfully passed Grade 12 or its equivalent as determined by the Board,

 

(b)          is physically able to perform all of the duties of the cook occupation, and

 

(c)           is willing to enter into an apprenticeship agreement in the cook occupation with an employer or a joint apprenticeship training committee.
