FREDERICTON (CNB) - The following statement was issued today by Health Minister Mary Schryer:
On Thursday, May 21, 2009, the New Brunswick Court of Appeal issued a decision in the Henry Morgentaler case.
The New Brunswick Court of Appeal decision concerned a procedural matter, namely the issue of standing, not the merits of the case.
This New Brunswick Court of Appeal decision has been reviewed by the Office of the Attorney General.
After reviewing the Court of Appeal decision, the Province of New Brunswick will not seek leave to appeal to the Supreme Court of Canada. Our government respects the court process and respects the decision of the New Brunswick Court of Appeal.
The legal case will continue to move forward. The position of the Province of New Brunswick has not changed in respect to this issue. As the larger legal matter remains before the courts, I will not make further comments.
