NB 998

Oct. 31, 2003

MIRAMICHI (CNB) - A former Crown prosecutor who was involved in the prosecution of some of New Brunswick's most notorious homicide cases was sworn in today as a judge of the Provincial Court of New Brunswick.

"Fred Ferguson is a most welcome addition to the Provincial Court," Justice Minister and Attorney General Brad Green said during a ceremony held at the new Miramichi Law Courts. "He brings with him a wealth of knowledge and experience gained from a 27-year career as a Crown prosecutor on the Miramichi."

Ferguson was educated at Mount Allison University, graduating with a Bachelor of Arts degree in 1973, and at the Law School of the University of New Brunswick, graduating in 1976. Prior to his appointment, he had been a Crown prosecutor with the Office of the Attorney General of New Brunswick for 27 years. During that period he was involved in the prosecution of murder charges against Allan Legere and the manslaughter trial of Steven and Lorelei Turner, among others.

He has written extensively, primarily in the Proceedings of Canada's National Criminal Law Program. He has been a member of the faculty of that program since 1989. He has taught extensively at the Bar Admission course in New Brunswick as well as at The Atlantic Police Academy. He has also lectured on a number of occasions to the National Association of Provincial Court Judges. In 1998, he was declared an expert in the field of criminal law in the trial of former Nova Scotia Premier Gerald Regan.

He has been actively involved in the activities of the Law Society of New Brunswick as both a member of the Executive Council, as well as several committees of the Society. He has been the Chair of the Admissions Committee of the Law Society for the past 10 years.

In 1996, he was named a Queen's Counsel and in 2002 he held the Milvain Chair in Advocacy at the University of Calgary School of Law. In 2003, he was named the first recipient (other than the award's name sake) of The Robert A. Murray Q.C. Award, awarded by the New Brunswick Crown Prosecutors Association. He is married and has twins who are fourth-year students at Dalhousie University in Halifax.

The appointment of Ferguson brings the number of Provincial Court judges in New Brunswick to 27.
