Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:



Mental Health Act

1                           Section 68 of the Mental Health Act, chapter M-10 of the Revised Statutes, 1973, is amended



(a)               in subsection (1)



(i)         by repealing paragraph (a) and substituting the following:



(a)               designating and classifying psychiatric facilities;



(ii)       by repealing paragraph (b);



(iii)    by adding after paragraph (o) the following:



(o.1)          respecting records to be maintained for persons who receive services from a psychiatric facility, or class of psychiatric facility, including the contents of the records and the preparation, maintenance, storage, removal and destruction of records;



(b)               by repealing subsection (2).



Mental Health Services Act

2(1)                   Section 1 of the Mental Health Services Act, chapter M-10.2 of the Acts of New Brunswick, 1997, is amended by repealing the definition "regional health authority".



2(2)                   Section 2 of the Act is amended



(a)               by repealing paragraph (a);



(b)               in paragraph (g) by striking out "a regional health authority, institution" and substituting "an institution".



2(3)                   Section 3 of the Act is amended



(a)               in subsection (1) by striking out "regional health authority,";



(b)               in subsection (2)



(i)         in paragraph (a) by striking out "a regional health authority, institution" and substituting "an institution";



(ii)       in paragraph (b) by striking out "regional health authority,";



(iii)    in paragraph (c) by striking out "regional health authority";



(c)               in subsection (4) by striking out "regional health authority,";



(d)               in subsection (6)



(i)         in paragraph (a) by striking out "regional health authority,";



(ii)       in paragraph (b) by striking out "regional health authority,";



(e)               in subsection (7) by striking out "regional health authority," wherever it appears.



Regional Health Authorities Act

3(1)                   Section 1 of the Regional Health Authorities Act, chapter R-5.05 of the Acts of New Brunswick, 2002, is amended



(a)               in the definition "health services" by adding "mental health services, public health services," after "addiction services,";



(b)               by adding the following definition in alphabetical order:



(i)         "public health services" means services provided to patients or members of the public through programs relating to sexuality, healthy lifestyles and immunization, and includes such other services as may be prescribed by regulation;



3(2)                   Section 72 of the Act is amended by adding after paragraph (s.3) the following:



(s.4)            prescribing services for the purposes of the definition "public health services";



Commencement

4                           This Act or any provision of it comes into force on a day or days to be fixed by proclamation.



EXPLANATORY NOTES



Sections 1 and 2



With the exception of subparagraph 1(a)(iii), these amendments are consequential on the amendments in section 3 of this amending Act. Subparagraph 1(a)(iii) adds new regulation-making authority to subsection 68(1) of the Mental Health Act.



Section 3



This section amends the definition of "health services" to include mental health services and public health services, and defines "public health services". Regulation-making authority is expanded to prescribe services that may be encompassed by the term "public health services".
