Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:
1 The Fish and Wildlife Act, chapter F-14.1 of the Acts of New Brunswick, 1980, is amended by adding after section 82 the following:
ABORIGINAL ACCESS TO FISH AND WILDLIFE
82.1(1) The Minister may, in his or her discretion, in order to accommodate the exercise of aboriginal and treaty rights,
(a) issue or authorize to be issued a licence to hunt, trap or snare any species of wildlife,
(b) issue or authorize to be issued a licence to angle for any species of fish, or
(c) with the approval of the Lieutenant-Governor in Council, enter into an agreement to hunt, trap or snare any species of wildlife, to angle for any species of fish or for any other matter related to the exercise of aboriginal and treaty rights.
82.1(2) Unless he or she can justify otherwise, the Minister, in exercising his or her authority under this section, shall not abrogate or derogate from any aboriginal or treaty rights of the aboriginal peoples of Canada under section 35 of the Constitution Act, 1982.
