Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:



1                           Section 1 of the Liquor Control Act, chapter L-10 of the Revised Statutes, 1973, is amended by adding the following definition in alphabetical order:



"after hours club" means any establishment open later than 2:30 a.m., which is considered by public safety agents to be disruptive to residences or businesses, or to be a general public nuisance;



2                           Section 124.2 of the Act is amended by adding after subsection (9) the following:



124.2(10)    The Minister shall cancel a licence referred to in paragraph 63(b), (b.1), (c), (d), (g) or (j) or issued under section 63.01 if the Minister is satisfied that the licensee owns, operates, or otherwise directly or indirectly controls or is involved in the operation of an after hours club.



124.2(11)    Any person who operates an after hours club commits a Category I offence under the Provincial Offences Procedure Act.
