Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:
1 An Act to Amend the Human Rights Act, chapter 21 of the Acts of New Brunswick, 2004, is amended by adding after section 1 the following:
1.1 Section 2 of the Act is amended by adding the following definition in alphabetical order:
"social condition", in respect of an individual, means the condition of inclusion of the individual in a socially identifiable group that suffers from social or economic disadvantage on the basis of his or her source of income, occupation or level of education;
2 The Act is amended by adding after section 6 the following:
6.1 The Act is amended by adding after section 7 the following:
7.01 Despite any provision of this Act, a limitation, specification, or preference on the basis of social condition shall be permitted if it is included in a programme established by the Crown in right of the Province, or in an Act or regulation, if the programme, Act or regulation is identified by a regulation made under this Act.
3 The Act is amended by adding after section 7 the following:
7.1 Section 16 of the Act is repealed.
7.2 The Act is amended by adding after section 27 the following:
28 The Lieutenant-Governor in Council may make regulations
(a) identifying the programmes, Acts and regulations falling within section 7.01;
(b) respecting any matter necessary or advisable to carry out effectively the intent and purpose of this Act.
Section 1 (adding section 1.1)
The effect of section 1.1 is to add a definition of "social condition" to section 2 of the Human Rights Act.
Section 2 (adding section 6.1)
Section 6.1 adds a new provision after section 7 of the Human Rights Act.
Section 3 (adding sections 7.1 and 7.2)
Section 7.1 repeals section 16 of the Human Rights Act.
Section 7.2 provides regulation-making authority in section 28 of the Human Rights Act.
