Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:



Definitions

1                           The following definitions apply in this Act.



"gas tax funding" means the federal gas tax revenue allocated to New Brunswick under the New Deal for Cities and Communities. (fonds provenant de la taxe sur l'essence)



"incorporated area" means a city, town or village. (secteur constitué en corporation)



"Minister" means the member of the Executive Council designated by the Lieutenant-Governor in Council. (ministre)



"New Deal for Cities and Communities" means the Government of Canada's initiative known as "A New Deal for Cities and Communities". (Nouveau pacte pour les villes et les collectivités)



"rural community" means a rural community as defined in the Municipalities Act. (communauté rurale)



"unincorporated area" means a local service district or, for the purposes of this Act, a rural community. (secteur non constitué en corporation)



Principle of equity

2                           The Government of New Brunswick is committed to ensuring equity between incorporated areas and unincorporated areas in the allocation of gas tax funding when an agreement is entered into between the Governments of Canada and New Brunswick under the New Deal for Cities and Communities.



Purpose

3                           Gas tax funding will provide incorporated areas and unincorporated areas with a source of funding for environmentally sustainable infrastructure projects.



Outcomes

4                           Gas tax funding will be directed toward the achievement of the environmental sustainability outcomes in the agreement referred to in section 2, including the following three key outcomes:



(a)               reduced greenhouse gas emissions;



(b)               cleaner water; and



(c)               cleaner air.



Allocation

5(1)                   Gas tax funding will be allocated annually between incorporated areas collectively and unincorporated areas collectively.



5(2)                   For the purposes of subsection (1), the portion for incorporated areas shall be determined on the basis of the ratio of their total population to the sum of the populations of incorporated areas and unincorporated areas.



5(3)                   For the purposes of subsection (1), the portion for unincorporated areas shall be determined on the basis of the ratio of their total population to the sum of the populations of incorporated areas and unincorporated areas.



5(4)                   The Minister shall determine the population by adopting the final population figure from the latest official census of Statistics Canada or by adopting the most reliable information otherwise available to the Minister.



Distribution

6(1)                   Subject to section 4, the Minister shall distribute the portion of gas tax funding allocated under subsection 5(2) to all incorporated areas on a per capita basis.



6(2)                   Subject to section 4, the Minister shall administer the portion of gas tax funding allocated under subsection 5(3) on the basis of need and regional considerations.



Administrative costs

7                           Notwithstanding sections 5 and 6, the costs incurred by the Government of New Brunswick to administer this Act may be paid out of the gas tax funding annually.



Commencement

8                           This Act or any provision of it comes into force on a day or days to be fixed by proclamation.
