WHEREAS the New Brunswick Podiatry Association Inc. prays that it be enacted as hereinafter set forth;
THEREFORE, Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:
1 Section 2 of An Act Respecting Podiatry, chapter 101 of the Acts of New Brunswick, 1983, is amended
(a) in subsection (1) by repealing the definition "podiatrist" and substituting the following:
"podiatrist" means a person who holds a current certificate of membership in the association and is certified to practice podiatry, acupuncture of the foot and massage in connection therewith and includes a chiropodist.
(b) by repealing subsection (2) and substituting the following:
2(2) The practice of podiatry does not include amputation of, or treatment of, or injuries to, or infection of the hands or fingers.
2 Subsection 15(1) of the Act is amended
(a) by striking out the word "shall" and substituting the word "may";
(b) by striking out the words ", in each year,"; and
(c) by striking out the words "one regular examination, and such supplemental examinations" and substituting the words "regular examinations and supplemental examinations".
3 Subsection 15(2) of the Act is amended by striking out the words "The examinations" and substituting the words "Any New Brunswick examinations".
4 Subsection 15(3) of the Act is repealed and the following is substituted:
15(3) The fee for a regular examination is five hundred dollars and the fee for a supplemental examination is one hundred dollars and these fees shall be paid in advance to the association.
15(4) The association will set the fees for regular and supplemental examinations by resolution at the annual general meeting.
5 Section 16 of the Act is amended by striking out the words ", in order to be admitted to the regular examination,".
6 Subsection 17(2) of the Act is amended by striking out the word "examination".
7 Subsection 18(1) of the Act is amended by striking out the word "shall" and substituting the word "may".
8 Section 20 of the Act is repealed and the following is substituted:
20 Subject to payment of the registration fee, the registrar shall enter in the register the required particulars respecting each applicant who has been certified by the registrar as having satisfactorily passed the New Brunswick or a Canadian provincial examination considered equivalent by the council and who has produced satisfactory evidence of his or her identity as being a person so certified, as well as evidence that he or her is at least twenty-one years of age and of good moral standing.
9 Section 28 of the Act is repealed and the following is substituted:
28 The initial registration fee for an applicant for a membership in the association is eight hundred dollars and seven hundred dollars per annum for an annual membership fee for each and every year thereafter.
28.1 The association will set the initial registration fee and the annual membership fee by resolution at the annual general meeting.
