Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:



Definitions

1                           The following definition applies to this Act.



"Minister" means the Minister of Training and Employment Development. (ministre)



Establishment of Board

2(1)                   The New Brunswick Community College Tuition Fee Review Board is established, hereinafter referred to as "the Board."



2(2)                   The Minister shall appoint seven members to the Board, no fewer than two of whom shall be students currently enrolled in an academic programme offered by the New Brunswick Community College.



Responsibilities of the Board and the Minister

3(1)                   Prior to any increase in tuition fees in any academic programme offered to the general public by the New Brunswick Community College, the Minister shall submit the proposed increase to the Board no less than one hundred and twenty days prior to the commencement of the academic programme in question.



3(2)                   The Board shall review and make recommendations in writing to the Minister on the proposed tuition fee increase within thirty days of having received such request from the Minister.



3(3)                   In reviewing the proposed increase in tuition fees, the Board shall take into account the following factors:



(a)               the financial situation of the New Brunswick Community College;



(b)               the effect of tuition fee increases upon accessibility to the programme;



(c)               the costs of offering the academic programme;



(d)               the financial benefits of the programme to the graduate;



(e)               the need to ensure community college graduates in the programme in question;



(f)                input from stakeholders and the general public; and



(g)               any other criteria deemed relevant by the Board.



3(4)                   The Minister shall file a response to the recommendations of the Board with the Speaker of the Legislative Assembly within fifteen days of their receipt.



3(5)                   The recommendations of the Board and the Minister's response shall be considered public documents.



4                           The Minister may set by regulation



(a)               the remuneration of members of the Board;



(b)               minimum qualifications of members of the Board;



(c)               standards of public consultation the Board must meet in making its recommendations; and



(d)               anything the Minister deems necessary to the execution of this Act.



Consequential Amendments

5                           Section 1 of the Adult Education and Training Act, chapter A-3.001 of the Acts of New Brunswick, 1980, is amended



(a)               by adding the following definition in alphabetical order:



"public spaces" means those spaces in a programme offered by an institution operating under the name "New Brunswick Community College" when the said programme is offered as a regular academic offering of the institution and for which the tuition fee charged does not reflect the entire cost of offering the programme.



(b)               by adding after section 3.2 the following:



3.3(1)             The Minister shall ensure that the number of public spaces in academic programmes offered by the New Brunswick Community College shall be increased from the base number of public spaces available in the 2004-2005 academic year and the Minister shall cause the number of public spaces to increase sufficiently to meet the following benchmarks:



(a)               by the academic year 2006-2007, there shall be a minimum of 6,000 additional public spaces available through the combined campuses of the New Brunswick Community College;



(b)               by the academic year 2008-2009, there shall be a minimum of 10,000 additional public spaces available through the combined campuses of the New Brunswick Community College; and



(c)                by the academic year 2010-2011, there shall be a minimum of 15,000 additional public spaces available through the combined campuses of the New Brunswick Community College.



3.3(2)             The annual report of the Department of Training and Employment Development shall provide the Legislative Assembly with an update on progress made towards the goals outlined in subsection (1).



3.3(3)             This section expires on December 31, 2011.



Commencement

6                           This Act comes into force on a date to be fixed by proclamation.
