Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:



1                           Subsection 7(1) of the Human Tissue Gift Act, chapter H-12.5 of the Acts of New Brunswick, 2004, is repealed and the following is substituted:



7(1)                   For the purposes of post-mortem removal of a human body part or parts for implantation in a living human body, the fact of death must be determined in accordance with accepted medical practice by



(a)               at least 2 medical practitioners, when the fact of death is determined in accordance with neurological criteria, or



(b)               one medical practitioner, when the fact of death is determined by other criteria.



2                           Section 15 of the Act is repealed.



EXPLANATORY NOTES



Section 1



The existing provision is as follows:



7(1)                   For the purposes of post-mortem removal of a human body part or parts for implantation in a living human body, the fact of death must be determined by at least two medical practitioners in accordance with accepted medical practice.



Section 2



The existing provision is as follows:



15                        This Act or any provision of this Act comes into force on a day or days to be fixed by proclamation.
