Amend said Bill as follows:
Section 2 is amended in the definition “practice of dental hygiene” by adding “subject to section 34.1,” after “practice of dental hygiene”.
Section 34 Subsection 2
Subsection 34(2) is amended by striking out “prohibit” and substituting “apply to or prevent”.
By adding after section 34 the following:
34.1 (1) The rules referred to in this section are rules respecting standards of practice under subsections 15(4) and 19(7) and rules on the subject matters referred to in this section shall be recommended to Council and the Minister for approval by a Committee known as the Dental Hygiene Practice Standards Committee consisting of
(a) two representatives appointed by the College,
(b) two dentists appointed by the College from a list of five names submitted by the New Brunswick Dental Society, and
(c) two representatives appointed by the Minister to represent the public, who are not members or employees of the College or the New Brunswick Dental Society,
appointed for terms of two years.
34.1 (2) A dental hygienist may engage in the practice of dental hygiene subject to the conditions and limitations imposed on the member’s licence, and in accordance with the rules and any practice exclusions contained in the rules, and may perform the practice of dental hygiene
(a) on the member’s own initiative, where the practice does not involve the scaling of teeth and root planing, including curetting of surrounding tissue;
(b) on the member’s own initiative where the practice does involve the scaling of teeth and root planing, including curetting of surrounding tissue, if none of the contra-indications prescribed in the rules to performing the procedure are present, and if the member ceases the procedure if any of the prescribed contra-indications to continuing the procedure are present; or
(c) if the procedure is ordered by a dentist licensed by the New Brunswick Dental Society or a physician authorized to practice medicine under the Medical Act.
34.1 (3) A dental hygienist shall only engage in the practice of dental hygiene to the extent that the practice is within the member’s individual scope of practice.
