Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:

1 Section 1 of the Civil Service Act, chapter C-5.1 of the Acts of New Brunswick, 1984, is amended

       (a) in the English version in the definition "open competition" by striking out the semicolon at the end of the definition and substituting a period;

       (b) in the French version in the definition «Ombudsman» by striking out the semicolon at the end of the definition and substituting a period;

       (c) by repealing the definition "Secretary of the Board".

2 Section 3.1 of the Act is amended

       (a) in subsection (1) by striking out "Secretary of the Board" and substituting "Deputy Minister of the Office of Human Resources";

       (b) in subsection (2) by striking out "Secretary of the Board" and substituting "Deputy Minister of the Office of Human Resources".

3 The heading "POWERS AND DUTIES OF THE SECRETARY OF THE BOARD" preceding section 4 of the Act is repealed and the following is substituted:

                                       POWERS AND DUTIES OF THE DEPUTY MINISTER OF THE OFFICE OF HUMAN RESOURCES

4 Section 4 of the Act is amended

       (a) in the portion preceding paragraph (a) by striking out "Secretary of the Board" and substituting "Deputy Minister of the Office of Human Resources";

       (b) in paragraph (d) by striking out "Secretary of the Board" wherever it appears and substituting "Deputy Minister of the Office of Human Resources".

5 Subsection 5(1) of the Act is amended by striking out "Secretary of the Board" and substituting "Deputy Minister of the Office of Human Resources".

6 Subsection 6(1) of the Act is amended by striking out "Secretary of the Board" and substituting "Deputy Minister of the Office of Human Resources".

7 Section 7 of the Act is amended by striking out "Secretary of the Board" and substituting "Deputy Minister of the Office of Human Resources".

8 Section 8 of the Act is amended in the portion preceding paragraph (a) by striking out "Secretary of the Board" and substituting "Deputy Minister of the Office of Human
Resources".

9 Section 9 of the Act is amended by striking out "Secretary of the Board" and substituting "Deputy Minister of the Office of Human Resources".

10 Section 11 of the Act is amended by striking out "Secretary of the Board" and substituting "Deputy Minister of the Office of Human Resources".

11 Section 12 of the Act is amended

       (a) in subsection (1) by striking out "Secretary of the Board" wherever it appears and substituting "Deputy Minister of the Office of Human Resources";

       (b) in subsection (2) by striking out "Secretary of the Board" and substituting "Deputy Minister of the Office of Human Resources".

12 Section 13 of the Act is amended

       (a) in subsection (1) by striking out "Secretary of the Board" and substituting "Deputy Minister of the Office of Human Resources";

       (b) in subsection (2) by striking out "Secretary of the Board" wherever it appears and substituting "Deputy Minister of the Office of Human Resources";

       (c) in subsection (3) in the portion preceding paragraph (a) by striking out "Secretary of the Board" and substituting "Deputy Minister of the Office of Human
       Resources";

       (d) in subsection (3.1) by striking out "Secretary of the Board" and substituting "Deputy Minister of the Office of Human Resources";

13 Subsection 15(2) of the Act is amended by striking out "Secretary of the Board" and substituting "Deputy Minister of the Office of Human Resources".

14 Subsection 16(1) of the Act is amended in the portion preceding paragraph (a) by striking out "Secretary of the Board" and substituting "Deputy Minister of the Office of
Human Resources".

15 Subsection 17(4) of the Act is amended by striking out "Secretary of the Board" and substituting "Deputy Minister of the Office of Human Resources".

16 Section 19 of the Act is amended by striking out "Secretary of the Board" and substituting "Deputy Minister of the Office of Human Resources".

17 Section 23 of the Act is amended

       (a) in subsection (4) by striking out "Secretary of the Board" wherever it appears and substituting "Deputy Minister of the Office of Human Resources";

       (b) in subsection (5) in the portion following paragraph (b) by striking out "Secretary of the Board" wherever it appears and substituting "Deputy Minister of the
       Office of Human Resources".

18 Section 26 of the Act is amended

       (a) in subsection (3) by striking out "Secretary of the Board" wherever it appears and substituting "Deputy Minister of the Office of Human Resources";

       (b) in subsection (4) by striking out "Secretary of the Board" and substituting "Deputy Minister of the Office of Human Resources".

19 Section 28 of the Act is amended by striking out "Secretary of the Board" wherever it appears and substituting "Deputy Minister of the Office of Human Resources".

20 Paragraph 31(1)(d) of the Act is amended by striking out "Secretary of the Board" and substituting "Deputy Minister of the Office of Human Resources".

21 Section 32 of the Act is amended

       (a) in subsection (1) in the portion following paragraph (b) by striking out "Secretary of the Board" and substituting "Deputy Minister of the Office of Human
       Resources";

       (b) in subsection (2) by striking out "Secretary of the Board" wherever it appears and substituting "Deputy Minister of the Office of Human Resources";

25(1) Section 3 of New Brunswick Regulation 84-229 under the Civil Service Act is amended

       (a) in subsection (1) by striking out "Secretary of the Board" wherever it appears and substituting "Deputy Minister of the Office of Human Resources";

       (b) in subsection (2) by striking out "Secretary of the Board" and substituting "Deputy Minister of the Office of Human Resources".

25(2) Section 4 of the Regulation is amended in the portion preceding paragraph (a) by striking out "Secretary of the Board" and substituting "Deputy Minister of the
Office of Human Resources".

25(3) Section 5 of the Regulation is amended

       (a) in subsection (1) by striking out "Secretary of the Board" and substituting "Deputy Minister of the Office of Human Resources";

25(7) Section 12 of the Regulation is amended

       (a) in subsection (1) by striking out "Secretary of the Board" and substituting "Deputy Minister of the Office of Human Resources";

26(1) The enacting clause of New Brunswick Regulation 84-230 under the Civil Service Act is amended by striking out "Secretary of the Board" and substituting "Deputy
Minister of the Office of Human Resources".

26(2) Section 3 of the Regulation is amended

       (a) in paragraph (c) by striking out "Secretary of the Board" and substituting "Deputy Minister of the Office of Human Resources";

       (b) in paragraph (i) by striking out "Secretary of the Board" and substituting "Deputy Minister of the Office of Human Resources";

       (c) in paragraph (i.01) by striking out "Secretary of the Board" and substituting "Deputy Minister of the Office of Human Resources";

27 The enacting clause of New Brunswick Regulation 95-17 under the Civil Service Act is amended by striking out "Secretary of the Board" and substituting "Deputy
Minister of the Office of Human Resources".

                                                                      Public Service Labour Relations Act

28 Subparagraph 19(2)(a)(ii) of the Public Service Labour Relations Act, chapter P-25 of the Revised Statutes, 1973, is amended by striking out "secretary of the Board of
Management" and substituting "Deputy Minister of the Office of Human Resources".

                                                                                 Commencement

29 This Act shall be deemed to have come into force on October 11, 2001.
