JUSTICE/ATTORNEY GENERAL

A. GENERAL DESCRIPTION:

The mandate of the Department is to promote the impartial administration of justice to ensure protection of the public interest through the dual offices of the Attorney General and Minister of Justice.

B. MANDATE/PROGRAM SYNOPSIS:

Attorney General - Legal Aid, Legal Services, Constitutional Law Unit, Legislative Services, and Public Prosecutions.

Court Services - Court Administration, the Court of Appeal, the Court of Queen's Bench, and Provincial Court.

Justice Services - Credit Unions, Co-operatives and Trust Companies, Examinations, Insurance, Office of the Rentalsman and Consumers Affairs, and Securities Administration.

C. PROGRAMS, POLICIES OR INITIATIVES IDENTIFIED BY THE DEPARTMENT AS IMPACTING ON WELLNESS:

Family Support Order Service _ provides for the collection of support payments and also the enforcement of support orders when payments are not made. Support orders filed with the court for purposes of enforcement are automatically enforced.

Domestic Legal Aid _ is available to victims of spousal abuse in matters such as spousal and child support, child custody and access, restraining orders, and some division of property. Legal representation is also available to clients who are not victims of spousal abuse to obtain and enforce family support orders. Mediation services are also provided by specially trained social workers. The program also offers, through Legal Aid New Brunswick, certificates to hire a lawyer to seek a variation in support obligations, where a payor has been found unable to pay support, and for representation in custody and guardianship applications by the Minister of Health and Community Services (now Minister of Family and Community Services).

For the Sake of the Children _ a six hour long course to assist families undergoing a divorce or separation to reduce the negative effects parents' conflicts may have on their children.
