Bill 12 - An Act to Amend the Prescription Drug Payment Act

Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:

1Section 2.1 of the Prescription Drug Payment Act, chapter P-15.01 of the Acts of New Brunswick, 1975, is amended

(a)in subsection (2) by striking out "New Brunswick Therapeutic Drug Formulary and Interchangeable Products List'' and substituting "New Brunswick Prescription Drug Program Formulary'';

(b)by adding after subsection (2) the following:

2.1(3)Notwithstanding any other provision of this Act, the Minister may determine the unit prices that are paid under the programme in respect of those drugs that are provided as an entitled service and that are

(a)single source products specified by the Minister, or

(b)interchangeable pharmaceutical products.

2Section 2.11 of the Act is amended

(a)in subsection (1)

(i)in the portion preceding paragraph (a) by striking out "New Brunswick Therapeutic Drug Formulary and Interchangeable Products List'' and substituting "New Brunswick Prescription Drug Program Formulary'';

(ii)in paragraph (b) by striking out "New Brunswick Therapeutic Drug Formulary and Interchangeable Products List'' and substituting "New Brunswick Prescription Drug Program Formulary'';

(b)in subsection (2) by striking out "New Brunswick Therapeutic Drug Formulary and Interchangeable Products List'' and substituting "New Brunswick Prescription Drug Program Formulary'';

(c)in subsection (4) in the portion preceding paragraph (a) by striking out "New Brunswick Therapeutic Drug Formulary and Interchangeable Products List'' and substituting "New Brunswick Prescription Drug Program Formulary''.

3Subsection 2.4(1) of the Act is amended by striking out "New Brunswick Therapeutic Drug Formulary and Interchangeable Products List'' and substituting "New Brunswick Prescription Drug Program Formulary''.

4Subsection 2.5(1) of the Act is amended in the definition "class or classes of drugs'' by striking out "New Brunswick Therapeutic Drug Formulary and Interchangeable Products List'' and substituting "New Brunswick Prescription Drug Program Formulary''.

5Paragraph 7(e.1) of the Act is repealed and the following is substituted:

(e.1)defining "interchangeable pharmaceutical product'' and "single source product'';

6This Act comes into force on April 1, 1998.

EXPLANATORY NOTES

Section 1

(a)The New Brunswick Therapeutic Drug Formulary and Interchangeable Products List is renamed as the New Brunswick Prescription Drug Program Formulary.

(b)The Minister is given the authority to determine the unit prices that are paid under the prescription drug programme for certain drugs.

Section 2

The amendments in this section are consequential on the amendment in paragraph 1(a) of this amending Act.

Section 3

The amendment in this section is consequential on the amendment in paragraph 1(a) of this amending Act.

Section 4

The amendment in this section is consequential on the amendment in paragraph 1(a) of this amending Act.

Section 5

The existing provision is as follows:

7For the purposes of carrying out the provisions of this Act according to their intent, the Lieutenant-Governor in Council may make regulations ...

(e.1)defining "interchangeable pharmaceutical product'';
