An Act to Amend the
Education Act

Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:

1Section 11 of the Education Act, chapter E-1.12 of the Acts of New Brunswick, 1997, is amended

(a)in subsection (1) by striking out ``superintendent'' and substituting ``director of education'';

(b)in subsection (3) by adding ``or section 12'' after ``subsection (1)''.

2Section 12 of the Act is amended

(a)in subsection (1) by striking out ``superintendent'' wherever it appears and substituting ``director of education'';

(b)in subsection (2) by striking out ``superintendent'' and substituting ``director of education'';

(c)in subsection (3) by striking out ``superintendent'' wherever it appears and substituting ``director of education'';

(d)in subsection (4) in the portion following paragraph (b) by striking out ``superintendent'' and substituting ``director of education''.

3Section 24 of the Act is amended

(a)in subsection (1)

(i)in subparagraph (a)(ii) by striking out ``superintendent'' and substituting ``director of education'';

(ii)in subparagraph (b)(ii) by striking out ``superintendent'' and substituting ``director of education'';

(b)in subsection (2) by striking out ``superintendent'' wherever it appears and substituting ``director of education'';

(c)in subsection (3) by striking out ``superintendent'' and substituting ``director of education'';

(d)by adding after subsection (5) the following:

24(6)A principal may, for the purposes of this section, designate a vice-principal of the school to act on behalf of the principal.

4Section 49 of the Act is amended by adding after subsection (2) the following:

49(3)A director of education may, except with respect to the director of education's duties provided for under subsection (2), designate persons to act on behalf of the director of education.

5Section 54 of the Act is amended

(a)in subsection (2) by striking out ``superintendent'' wherever it appears and substituting ``director of education'';

(b)in subsection (3)

(i)in the portion preceding paragraph (a) by striking out ``superintendent'' wherever it appears and substituting ``director of education'';

(ii)in paragraph (b) by striking out ``superintendent'' wherever it appears and substituting ``director of education'';

(c)in subsection (4) by striking out ``superintendent'' wherever it appears and substituting ``director of education'';

(d)in subsection (6) by striking out ``superintendent'' wherever it appears and substituting ``director of education''.

EXPLANATORY NOTES

Section 1

(a)The amendment shifts the authority of a superintendent under section 11 of the Education Act to a director of education.

(b)The existing provision is as follows:

11(3)The parent of a pupil or an independent pupil may, in accordance with the regulations, appeal a decision made under subsection (1) in respect of the placement of the pupil.

Section 2

The amendments shift the authority of a superintendent under section 12 of the Education Act to a director of education.

Section 3

(a) to (c)The amendments shift the authority of a superintendent under section 24 of the Education Act to a director of education.

(d)A principal is authorized to designate a vice-principal of the school to act on behalf of the principal for the purposes of section 24 of the Education Act.

Section 4

A director of education is authorized to designate persons to act on behalf of the director of education except with respect to the director of education's duties provided for under subsection 49(2) of the Education Act.

Section 5

The amendments shift the authority of a superintendent under section 54 of the Education Act to a director of education.
