An Act to Amend the Advisory Council on the Status of Women Act

Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:

1Section 4 of the Advisory Council on the Status of Women Act, chapter A-3.1 of the Acts of New Brunswick, 1975, is amended

(a)in subsection (1) by striking out "twelve" and substituting "thirteen";

(b)by adding after subsection (2) the following:

4(2.1)On and after the commencement of this subsection,

(a)with respect to the members of the Council, other than the chairperson, one member shall be appointed from each of the twelve regions in the Province determined by the Minister from time to time, and

(b)the chairperson shall be appointed from any of the said twelve regions.

4(2.2)The Regulations Act does not apply to a determination by the Minister under subsection (2.1).

4(2.3)Members of the Council immediately before the commencement of this subsection shall be deemed to have been appointed under subsection (2.1) and shall continue to serve the remainder of their term.

2Subsection 5(2) of the Act is amended by adding ", in accordance with subsection 4(2.1)," after "The Lieutenant-Governor in Council shall".

3Section 6 of the Act is amended by adding ", in accordance with subsection 4(2.1)," after "the Lieutenant-Governor in Council".

4Section 7 of the Act is repealed and the following is substituted:

7The chairperson shall direct the activities of the Council and coordinate its work.

5The Act is amended by adding after section 8 the following:

8.1(1)Before the commencement of each fiscal year, the Council shall submit to the Minister an action plan in accordance with the by-laws of the Council.

8.1(2)The Council may revise an action plan at any time during the fiscal year and shall submit the revised action plan to the Minister.

6Subsection 9(1) of the Act is amended by striking out "September 30" and substituting "July 31".

7Section 10 of the Act is repealed and the following is substituted:

10Subject to the funds appropriated under section 9, the Council

(a) may engage a chief executive officer in accordance with the by-laws of the Council; and

(b)may employ or engage other persons in accordance with the by-laws of the Council.

8The Act is amended by adding after section 10 the following:

10.1(1)The chief executive officer is responsible to the Council for carrying out the directives of the Council within the guidelines established by the Council.

10.1(2)The Regulations Act does not apply to guidelines under subsection (1).

9This Act or any provision of it comes into force on a day or days to be fixed by proclamation.

EXPLANATORY NOTES

Section 1

(a)The number of members of the Advisory Council on the Status of Women is increased from twelve to thirteen.

(b)Twelve members of the Advisory Council on the Status of Women are to be appointed from the twelve regions established for the Province. The chairperson of the Council is to be appointed from any of those twelve regions.

Section 2

The existing provision is as follows:

5(2)The Lieutenant-Governor in Council shall reappoint or replace a member within three months of the expiry of that member's term.

The existing provision is as follows:

6Where a vacancy occurs during the term of office of a member, that position shall be filled by an appointment made by the Lieutenant-Governor in Council for the remainder of the term of that person.

Section 4

The existing provision is as follows:

7The chairperson is the chief executive officer of the council and shall direct the activities of the Council and co-ordinate its work.

Section 5

Before the commencement of each fiscal year, the Advisory Council on the Status of Women must submit an action plan in accordance with the by-laws of the Council. An action plan may be revised during the fiscal year.

Section 6

The existing provision is as follows:

9(1)Each year, on or before September 30, the Council shall submit to the Minister an estimate of the money required for the operation of the Council during the next fiscal year.

Section 7

The existing provision is as follows:

10Subject to the funds appropriated under section 9, the Council may employ or engage such persons as it considers necessary to carry out the purposes of this Act.

Section 8

The amendment provides for the duties of a chief executive officer.
