Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:

Agricultural Operation Practices Act

1Paragraph 2(b) of the Agricultural Operation Practices Act, chapter A-5.2 of the Acts of New Brunswick, 1986, is amended by striking out "Health Act" and substituting "Public Health Act".

Ambulance Services Act

2(1)Section 1 of the Ambulances Services Act, chapter A-7.3 of the Acts of New Brunswick, 1990, is amended

(a)in the English version by repealing the definition "district";

(b)in the English version by striking out the period at the end of the definition "patient" and substituting a semicolon;

(c)in the English version by adding after the definition "patient" the following:

"region" means, subject to subsection 7(4), a health region established under the Public Health Act.

(d)in the French version by repealing the definition "région" and substituting the following:

\xc7 région\xc8 désigne, sous réserve du paragraphe 7(4), une région sanitaire établie en vertu de la Loi sur la santé publique.

2(2)Subsection 6(2) of the English version of the Act is amended by striking out "district" and substituting "region".

2(3)Section 7 of the English version of the Act is amended

(a)in subsection (1) by striking out "district" and substituting "region";

(b)in subsection (2)

(i)in paragraph (a) by striking out "district" and substituting "region";

(ii)in paragraph (b) by striking out "district" and substituting "region";

(iii)in the portion following paragraph (e) by striking out "district" and substituting "region";

(c)in subsection (3)

(i)in paragraph (b) by striking out "district" and substituting "region";

(ii)in the portion following paragraph (b) by striking out "district" and substituting "region";

(d)in subsection (4) by striking out "district" wherever it appears and substituting "region".

2(4)Subsection 8(2) of the English version of the Act is amended by striking out "district" and substituting "region".

2(5)Section 9 of the English version of the Act is amended

(a)in subsection (1) by striking out "district" wherever it appears and substituting "region";

(b)in subsection (2) by striking out "district" wherever it appears and substituting "region".

Cemetery Companies Act

3The Cemetery Companies Act, chapter C-1 of the Revised Statutes, 1973, is amended

(a)in section 15 by striking out "Medical Health Officer" and substituting "medical officer of health";

(b)by repealing section 36 and substituting the following:

36No body shall be cremated within forty-eight hours after decease unless

(a)death has been occasioned by a notifiable disease quarantinable or liable to quarantine under the Public Health Act or regulations passed under the authority thereof, and so certified by a duly qualified medical practitioner, in which case a medical officer of health may order that the body of the deceased shall be cremated forthwith, or

(b)exceptional circumstances arise that in the opinion of the chief medical officer of health of the Province warrant such action, when he may issue a permit for cremation within a shorter time.

Clean Water Act

4(1)Subsection 3(2) of the Clean Water Act, chapter C-6.1 of the Acts of New Brunswick, 1989, is amended by striking out "Health Act" wherever it appears and substituting "Public Health Act".

4(2)Section 13.1 of the Act is amended

(a)in subsection (1) by repealing the definition "Chief Medical Officer" and substituting the following:

"chief medical officer of health" means the chief medical officer of health appointed by the Minister of Health and Community Services under the Public Health Act or the person appointed by the Minister of Health and Community Services as the acting chief medical officer of health under that act;

(b)in paragraph (3)(a) by striking out "Chief Medical Officer" and substituting "chief medical officer of health".

Dairy Products Act

5(1)Section 18 of the Dairy Products Act, chapter D-2 of the Revised Statutes, 1973, is amended in the portion preceding paragraph (a) by striking out "Health Act" and substituting "Public Health Act".

5(2)Section 30 of the Act is amended in the portion preceding paragraph (a) by striking out "Health Act" and substituting "Public Health Act".

Education Act

6(1)Section 10 of the Education Act, chapter E-1.12 of the Acts of New Brunswick, 1997, is amended

(a)in subsection (1) by striking out "Health Act" and substituting "Public Health Act";

(b)in paragraph (2)(b) by striking out "Health Act" and substituting "Public Health Act".

6(2)Paragraph 57(u) of the Act is amended by striking out "Health Act" and substituting "Public Health Act".

Expropriation Act

7Subsection 2(4) of the Expropriation Act, chapter E-14 of the Revised Statutes, 1973, is amended by striking out "Subsection (3) does not apply to a taking of possession under subsection 10(1) of the Health Act" and substituting "Subsection (3) does not apply to a taking of possession under section 26 of the Public Health Act".

Liquor Control Act

8Paragraph 111.1(3)(a) of the Liquor Control Act, chapter L-10 of the Revised Statutes, 1973, is amended by striking out "Health Act" and substituting "Public Health Act".

Municipalities Act

9(1)Section 125 of the Municipalities Act, chapter M-22 of the Revised Statutes, 1973, is amended

(a)in subsection (1) by striking out "Where the Minister of Health and Community Services under authority of the Health Act orders changes or additions to be made to an existing system of water works, sewage or sewage disposal by the municipality" and substituting "Where the Minister of Health and Community Services under authority of the Public Health Act orders changes or additions to be made to an existing system of water works by the municipality";

(b)in subsection (2) by striking out "Health Act" and substituting "Public Health Act".

9(2)Paragraph 188(2)(g) of the English version of the Act is amended by striking out "Health Act" and substituting "Public Health Act".

Vital Statistics Act

10(1)Paragraph 16(2)(c) of the English version of the Vital Statistics Act, chapter V-3 of the Acts of New Brunswick, 1979, is amended by striking out "medical health officer" and substituting "medical officer of health".

10(2)Subsection 29(4) of the Act is amended by striking out "district medical health officer" wherever it appears and substituting "medical officer of health".

10(3)Subsection 30(2) of the Act is amended by striking out "district medical health officer" and substituting "medical officer of health".

Commencement

11This Act or any provision of it comes into force on a day or days to be fixed by proclamation.

EXPLANATORY NOTE

Sections 1 to 10

These are consequential amendments to terminology necessitated by the Public Health Act.

(a)in the English version strike out "district -- région";

(b)in the English version add "region -- région" after "patient -- malade";
