An Act to Amend the Executive Council Act

 

 

Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:

1 Subsection 2(1) of the Executive Council Act, chapter E-12 of the Revised Statutes, 1973, is repealed and the following is substituted:

2(1) The Lieutenant-Governor may appoint, under the Great Seal of the Province, from among the members of the Executive Council the following Ministers who shall hold office during pleasure: a President of the Executive Council, an Attorney General who shall also be Minister of Justice, a Solicitor General, a Minister of Finance, a Minister of Supply and Services, a Minister of Transportation, a Minister of Natural Resources and Energy, a Minister of Agriculture and Rural Development, a Minister of Health and Community Services, a Minister of Human Resources Development, a Minister of Labour, a Minister of Education, a Minister of Municipalities and Housing, a Minister of the Environment, a Minister of Economic Development, Tourism and Culture, a Minister of Fisheries and Aquaculture and a Minister of Intergovernmental and Aboriginal Affairs.

 

 

2(1) Where in any Act, other than this Act, or in any regulation, rule, order, by-law, agreement or other instrument or document, reference is made to the Minister, Deputy Minister or Department of Economic Development and Tourism, it shall be read, unless the context otherwise requires, as a reference to the Minister, Deputy Minister or Department of Economic Development, Tourism and Culture.

2(2) Where in any Act, other than this Act, or in any regulation, rule, order, by-law, agreement or other instrument or document, reference is made to the Minister, Deputy Minister or Department of Intergovernmental Affairs, it shall be read, unless the context otherwise requires, as a reference to the Minister, Deputy Minister or Department of Intergovernmental and Aboriginal Affairs.

 

2(3) Where in any Act, other than this Act, or in any regulation, rule, order, by-law, agreement or other instrument or document, reference is made to the Minister, Deputy Minister or Department of Advanced Education and Labour, it shall be read, unless the context otherwise requires, as a reference to

(a) the Minister, Deputy Minister or Department of Education, or

(b) the Minister, Deputy Minister or Department of Labour,

as the case may be.

2(4) Where in any Act, other than this Act, or in any regulation, rule, order, by-law, agreement or other instrument or document, reference is made to the Minister, Deputy Minister or Department of Municipalities, Culture and Housing, it shall be read, unless the context otherwise requires, as a reference to

(a) the Minister, Deputy Minister or Department of Economic Development, Tourism and Culture, or

(b) the Minister, Deputy Minister or Department of Municipalities and Housing,

as the case may be.

Adult Education and Training Act

 

3 Section 1 of the Adult Education and Training Act, chapter A-3.001 of the Acts of New Brunswick, 1980, formerly known as the New Brunswick Community College Act, chapter N-4.01 of the Acts of New Brunswick, 1980, is amended

 

 

(a) by repealing the definition "Department" and substituting the following:

"Department" means the Department of Education;

(b) by repealing the definition "Minister" and substituting the following:

"Minister" means the Minister of Education;

4 The enacting clause of New Brunswick Regulation 88-198 under the Adult Education and Training Act is amended by striking out "Minister of Advanced Education and Training" and substituting "Minister".

 

Agricultural Land Protection
and Development Act

5(1) Section 1 of the Agricultural Land Protection and Development Act, chapter A-5.11 of the Acts of New Brunswick, 1996, is amended in the definition "local government" by striking out "Minister of Municipalities, Culture and Housing" and substituting "Minister of Municipalities and Housing".

 

5(2) Subsection 10(2) of the Act is amended in the portion preceding paragraph (a) by striking out "Minister of Municipalities, Culture and Housing" and substituting "Minister of Municipalities and Housing".

5(3) Section 11 of the Act is amended by striking out "Minister of Municipalities, Culture and Housing" and substituting "Minister of Municipalities and Housing".

 

6 Subsection 9(1) of New Brunswick Regulation 97-83 under the Agricultural Land Protection and Development Act is amended by striking out "Department of Municipalities, Culture and Housing" and substituting "Department of Municipalities and Housing".

 

Ambulance Services Act

7 Subsection 4(2) of the Ambulance Services Act, chapter A-7.3 of the Acts of New Brunswick, 1990, is amended

(a) in paragraph (g) by striking out "Department of Municipalities, Culture and Housing" and substituting "Department of Municipalities and Housing";

(b) in paragraph (h) by striking out "Department of Advanced Education and Labour" and substituting "Department of Education".

 

Apprenticeship and Occupational
Certification Act

8(1) Section 1 of the Apprenticeship and Occupational Certification Act, chapter A-9.1 of the Revised Statutes, 1973, formerly known as the Industrial Training and Certification Act, chapter I-7 of the Revised Statutes, 1973, is amended by repealing the definition "Minister" and substituting the following:

"Minister" means the Minister of Labour and includes a person designated by the Minister to act on the Ministerís behalf;

8(2) Paragraph 6(1)(c) of the Act is amended by striking out "Department of Advanced Education and Labour" and substituting "Department of Labour".

8(3) Paragraph 7(2)(b) of the Act is amended by striking out "Department of Advanced Education and Labour" and substituting "Department of Labour".

9 Schedule C of New Brunswick Regulation 97-125 under the Apprenticeship and Occupational Certification Act is amended in subsection 71(7) by striking out "Department of Advanced Education and Labour" and substituting "Department of Labour".

 

Arts Development Trust Fund Act

 

10(1) Section 3 of the Arts Development Trust Fund Act, chapter A-13.1 of the Acts of New Brunswick, 1990, is amended by striking out "Minister of Municipalities, Culture and Housing" and substituting "Minister of Economic Development, Tourism and Culture".

 

10(2) Section 4 of the Act is amended

(a) in subsection (1) by striking out "Minister of Municipalities, Culture and Housing" and substituting "Minister of Economic Development, Tourism and Culture";

 

(b) in subsection (2) by striking out "Minister of Municipalities, Culture and Housing" and substituting "Minister of Economic Development, Tourism and Culture".

 

10(3) Section 2 of An Act to Amend the Arts Development Trust Fund Act, chapter 24 of the Acts of New Brunswick, 1998, is amended in section 3 as enacted by section 2 in the portion preceding paragraph (a) by striking out "Minister of Municipalities, Culture and Housing" and substituting "Minister of Economic Development, Tourism and Culture".

 

Assessment Act

11 Subparagraph 29(1.2)(a)(ii) of the Assessment Act, chapter A-14 of the Revised Statutes, 1973, is amended by striking out "Minister of Municipalities, Culture and Housing" and substituting "Minister of Municipalities and Housing".

Beaverbrook Art Gallery Act

12 Subparagraph 5(2)(a)(ii.1) of the Beaverbrook Art Gallery Act, chapter B-1 of the Revised Statutes, 1973, is repealed and the following is substituted:

(ii.1) the Minister of Economic Development, Tourism and Culture,

Boiler and Pressure Vessel Act

13 Section 1 of the Boiler and Pressure Vessel Act, chapter B-7.1 of the Acts of New Brunswick, 1976, is amended by repealing the definition "Minister" and substituting the following:

 

"Minister" means the Minister of Labour and includes a person designated by the Minister under section 3 to act on the Ministerís behalf;

14 Section 201 of New Brunswick Regulation 84-174 under the Boiler and Pressure Vessel Act is amended by repealing the definition "Department" and substituting the following:

 

"Department" means the Department of Labour;

Business Improvement Areas Act

15 Subsection 1(1) of the Business Improvement Areas Act, chapter B-10.2 of the Acts of New Brunswick, 1985, is amended by repealing the definition "Minister" and substituting the following:

Cemetery Companies Act

16 Paragraph 5(1)(b) of the Cemetery Companies Act, chapter C-1 of the Revised Statutes, 1973, is amended by striking out "Minister of Municipalities, Culture and Housing" and substituting "Minister of Municipalities and Housing".

17(1) Section 12 of New Brunswick Regulation 94-129 under the Cemetery Companies Act is amended

(a) in subparagraph (4)(b)(v) by striking out "Minister of Municipalities, Culture and Housing" and substituting "Minister of Municipalities and Housing";

(b) in subparagraph (5)(b)(v) by striking out "Minister of Municipalities, Culture and Housing" and substituting "Minister of Municipalities and Housing".

23(3) Clause 54(6)(g)(v)(C) of the Act is amended by striking out "Minister of Municipalities, Culture and Housing" and substituting "Minister of Municipalities and Housing".

36(1) Section 7 of the Controverted Elections Act, chapter C-21 of the Revised Statutes, 1973, is amended by striking out "Minister of Municipalities, Culture and Housing" and substituting "Chief Electoral Officer".

 

36(2) Section 33 of the Act is amended by striking out "Minister of Municipalities, Culture and Housing" and substituting "Lieutenant-Governor in Council".

Economic Development Act

37(1) Section 1 of the Economic Development Act, chapter E-1.11 of the Acts of New Brunswick, 1975, formerly known as the Commerce and Technology Act, chapter C-8.1 of the Acts of New Brunswick, 1975, is amended by repealing the definition "Minister" and substituting the following:

 

"Minister" means the Minister of Economic Development, Tourism and Culture and includes anyone designated by the Minister to act on the Ministerís behalf;

37(2) Subsection 15(7) of the Act is amended by striking out "Minister of Economic Development and Tourism" and substituting "Minister of Economic Development, Tourism and Culture".

 

38 Section 2 of New Brunswick Regulation 82-197 under the Economic Development Act is repealed and the following is substituted:

 

2 In this Regulation

"Act" means the Economic Development Act.

 

Edmundston Act, 1998

39 Subsection 1(1) of the Edmundston Act, 1998, chapter E-1.111 of the Acts of New Brunswick, 1998, is amended by repealing the definition "Minister" and substituting the following:

 

"Minister" means the Minister of Municipalities and Housing;

Elections Act

40 Schedule C of the Elections Act, chapter E-3 of the Revised Statutes, 1973, is amended in section 3) by striking out "Department of Municipalities, Culture and Housing" and substituting "Department of Municipalities and Housing".

 

Electrical Installation and Inspection Act

 

41 Section 1 of the Electrical Installation and Inspection Act, chapter E-4.1 of the Acts of New Brunswick, 1976, is amended by repealing the definition "Minister" and substituting the following:

"Minister" means the Minister of Labour;

42 Paragraph 11(3)(a) of New Brunswick Regulation 84-165 under the Electrical Installation and Inspection Act is amended by striking out "Department of Advanced Education and Labour" and substituting "Department of Labour".

 

Elevators and Lifts Act

43 Section 1 of the Elevators and Lifts Act, chapter E-6 of the Revised Statutes, 1973, is amended by repealing the definition "Minister" and substituting the following:

"Minister" means the Minister of Labour;

44 Subsection 2(1) of New Brunswick Regulation 84-181 under the Elevators and Lifts Act is amended by repealing the definition "Department" and substituting the following:

 

"Department" means the Department of Labour;

Emergency 911 Act

45 Section 1 of the Emergency 911 Act, chapter E-6.1 of the Acts of New Brunswick, 1994, is amended by repealing the definition "Minister" and substituting the following:

 

"Minister" means the Minister of Municipalities and Housing and includes persons designated by the Minister under subsection 7(2) to act on the Ministerís behalf;

Emergency Measures Act

46 Section 1 of the Emergency Measures Act, chapter E-7.1 of the Acts of New Brunswick, 1978, is amended by repealing the definition "Minister" and substituting the following:

 

"Minister" means the Minister of Municipalities and Housing;

47(1) Paragraph 3(4)(b) of New Brunswick Regulation 83-71 under the Emergency Measures Act is amended by striking out "Minister of Municipal Affairs" and substituting "Minister".

 

47(2) Section 5 of the Regulation is amended

(a) in subsection (1) of the English version by striking out "Minister of Municipal Affairs" and substituting "Minister";

48(2) Section 6 of the Regulation is amended by striking out ", in accordance with the security instructions attached to this Regulation as Schedule A,".

48(3) Schedule A of the Regulation is repealed.

Employment Development Act

49 Section 1 of the Employment Development Act, chapter E-7.11 of the Acts of New Brunswick, 1988, is amended by repealing the definition "Minister" and substituting the following:

 

"Minister" means the Minister of Labour and includes persons designated by the Minister under section 5 to act on the Ministerís behalf.

Employment Standards Act

50(1) Section 1 of the Employment Standards Act, chapter E-7.2 of the Acts of New Brunswick, 1982, is amended by repealing the definition "Minister" and substituting the following:

 

"Minister" means the Minister of Labour;

50(2) Subsection 45(1) of the Act is amended by striking out "Minister of Advanced Education and Labour" and substituting "Minister".

 

50(3) Section 87 of the Act is amended by striking out "Department of Advanced Education and Labour" and substituting "Department of Labour".

51 Form 2 of New Brunswick Regulation 85-179 under the Employment Standards Act is amended by striking out "Department of Labour and Human Resources" and substituting "Department of Labour".

 

Evidence Act

52(1) Section 88 of the Evidence Act, chapter E-11 of the Revised Statutes, 1973, is amended by striking out "Minister of Municipalities, Culture and Housing" and substituting "Minister of Municipalities and Housing".

 

52(2) Section 89 of the Act is amended by striking out "Minister of Municipalities, Culture and Housing" and substituting "Minister of Municipalities and Housing".

 

52(3) Section 90 of the Act is amended

(a) in subsection (1) by striking out "Minister of Municipalities, Culture and Housing" and substituting "Minister of Municipalities and Housing";

(b) in subsection (2) by striking out "Minister of Municipalities, Culture and Housing" and substituting "Minister of Municipalities and Housing".

Family Income Security Act

53 Subsection 8(2) of New Brunswick Regulation 95-61 under the Family Income Security Act is amended

(a) in paragraph (e.2) by striking out "Minister of Advanced Education and Labour as an interest-free loan under the New Brunswick Entrepreneur Program" and substituting "Minister of Labour as an interest-free loan under the Entrepreneur Program";

 

(b) in paragraph (e.3) by striking out "Minister of Advanced Education and Labour" and substituting "Minister of Labour".

(f) parts and supplies to be used in the repair and overhauling of equipment which is charged back to the owner of the equipment but not including tools or items to be placed in stock; and

103 Paragraph 15.1(3)(b) of the Service New Brunswick Act, chapter S-6.2 of the Acts of New Brunswick, 1989, formerly known as the New Brunswick Geographic Information Corporation Act, chapter N-5.01 of the Acts of New Brunswick, 1989, is amended by striking out "Department of Municipalities, Culture and Housing" and substituting "Department of Municipalities and Housing".

 

Sport Development Trust Fund Act

 

104(1) Section 4 of the Sport Development Trust Fund Act, chapter S-12.12 of the Acts of New Brunswick, 1990, is amended by striking out "Minister of Municipalities, Culture and Housing" wherever it appears and substituting "Minister of Municipalities and Housing".

 

104(2) Section 5 of the Act is amended

(a) in subsection (1) by striking out "Minister of Municipalities, Culture and Housing" and substituting "Minister of Municipalities and Housing";

(b) in subsection (2) by striking out "Minister of Municipalities, Culture and Housing" and substituting "Minister of Municipalities and Housing".

Stock Savings Plan Act

105 Subsection 1(1) of the Stock Savings Plan Act, chapter S-14.2 of the Acts of New Brunswick, 1989, is amended by repealing the definition "Minister" and substituting the following:

 

"Minister" means the Minister of Economic Development, Tourism and Culture and includes anyone designated by the Minister to act on the Ministerís behalf;

Tourism Development Act

106 Section 1 of the Tourism Development Act, chapter T-9 of the Revised Statutes, 1973, is amended by repealing the definition "Minister" and substituting the following:

"Minister" means the Minister of Economic Development, Tourism and Culture;

107(1) Section 2 of New Brunswick Regulation 81-198 under the Tourism Development Act is amended by repealing the definition "Minister".

 

107(2) Form 1 of the Regulation is amended

(a) by striking out "Minister of Tourism" and substituting "Minister";

(b) by striking out "DEPARTMENT OF TOURISM" and substituting "DEPARTMENT OF ECONOMIC DEVELOPMENT, TOURISM AND CULTURE".

 

107(3) Form 3 of the Regulation is amended by striking out "Minister of Tourism" and substituting "Minister".

107(4) Form 4 of the Regulation is amended by striking out "Minister of Tourism" and substituting "Minister".

107(5) Form 5 of the Regulation is amended by striking out "Department of Tourism" and substituting "Department of Economic Development, Tourism and Culture".

Workersí Compensation Act

108(1) Section 83.1 of the Workersí Compensation Act, chapter W-13 of the Revised Statutes, 1973, is amended

(a) in subsection (1) by striking out "Department of Advanced Education and Labour" and substituting "Department of Labour";

 

(b) in subsection (3) by striking out "Department of Advanced Education and Labour" and substituting "Department of Labour".

 

108(2) Section 83.2 of the Act is amended

(a) in subsection (1) by striking out "Department of Advanced Education and Labour" and substituting "Department of Labour";

 

(b) in subsection (3) by striking out "Department of Advanced Education and Labour" and substituting "Department of Labour".

 

Workplace Health, Safety and
Compensation Commission Act

109 Section 1 of the Workplace Health, Safety and Compensation Commission Act, chapter W-14 of the Acts of New Brunswick, 1994, is amended by repealing the definition "Minister" and substituting the following:

 

"Minister" means the Minister of Labour.

Youth Assistance Act

110(1) Section 1 of the Youth Assistance Act, chapter Y-2 of the Acts of New Brunswick, 1984, is amended by repealing the definition "Minister" and substituting the following:

 

"Minister" means the Minister of Education and includes a person designated under section 2 to act on the Ministerís behalf.

110(2) Subsection 10(1) of the Act is amended by striking out "Minister of Municipalities, Culture and Housing" and substituting "Minister of Economic Development, Tourism and Culture".

 

110(3) Subsection 11(1) of the Act is amended by striking out "Minister of Municipalities, Culture and Housing" and substituting "Minister of Municipalities and Housing".

 

EXPLANATORY NOTES

Section 1

A number of changes are made to subsection 2(1) of the Executive Council Act which authorizes the appointment of Ministers from among members of the Executive Council.

References to the following Ministers are deleted:
