An Act to Amend An Act to Dedicate Certain Lands in The City of Fredericton as a Public Park
WHEREAS The City of Fredericton prays that it be enacted as hereinafter set so to forth;
THEREFORE, Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:
1 Section 5 of An Act to Dedicate Certain Lands in The City of Fredericton as a Public Park, chapter 101 of the Acts of New Brunswick 1992, is repealed and the following is substituted therefor:
5 Notwithstanding anything herein contained, The City of Fredericton may sell and convey free from any restriction imposed by this Act a certain parcel of the said lands and premises bounded and described as follows:
(a) Commencing at an iron pin on the northwesterly side of Smythe Street at the easterly corner of lands of Winnifred DeSaulnier; thence running North 43 degrees 52 minutes West, a distance of 506 feet, more or less, to the northerly corner of lands of Winnifred DeSaulnier and Donald Rogers; thence in a northeasterly direction a rectangular distance of 12 feet to the southwesterly limit of Waggoner’s Lane; thence South 43 degrees 52 minutes East along said Waggoner’s Lane a distance of 506 feet, more or less, to the northwesterly limit of Smythe Street; thence South 52 degrees 35 minutes West along Smythe Street a rectangular distance of 12 feet to the place of beginning;
(b) Beginning at a point where the westerly corner of Odell Park meets the northerly property line of Waggoner’s Lane; thence in an easterly direction on an azimuth of 100 degrees 32 minutes a distance of 45.482 metres (149.22 feet) to a point; thence in a southerly direction on an azimuth of 190 degrees 32 minutes a distance of 21.369 metres (70.11 feet); thence in a westerly direction along the northerly property line of Waggoner’s Lane on an azimuth of 305 degrees 42 minutes a distance of 50.252 metres (164.87 feet) to the place of beginning.
