An Act to Amend the Judicature Act

 

 

Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:

1 Section 2 of the Judicature Act, chapter J-2 of the Revised Statutes, 1973, is amended

 

(a) in subsection (3) by striking out "twenty-one" and substituting "twenty-two";

 

(b) in subsection (4.1) by striking out "eight" and substituting "nine".

2 Section 4 of the Act is amended

(a) in subsection (1)

(i) in paragraph (d) of the French version by striking out "Edmunston" and substituting "Edmundston";

(ii) in paragraph (h) by striking out "the Town of Newcastle" and substituting "Miramichi";

(b) in paragraph (1.1)(f) by striking out "one judge" and substituting "two judges".

3 This Act or any provision of it comes into force on a day or days to be fixed by proclamation.

EXPLANATORY NOTES

Section 1

(a) The existing provision is as follows:

2(3) The Court of Queen’s Bench shall consist of the Chief Justice of the Court of Queen’s Bench, twenty-one other judges, any former judge of the Court of Queen’s Bench who is a supernumerary judge and any former Chief Justice of the Court of Queen’s Bench who is a judge or a supernumerary judge.

(b) The existing provision is as follows:

2(4.1) Of the judges of the Court of Queen’s Bench eight shall be judges of the Family Division.

Section 2

(a)(i) A typographical error is corrected.

(a)(ii) A reference to the Town of Newcastle is changed to Miramichi.

(b) The existing provision is as follows:

4(1.1) Judges of the Family Division of the Court of Queen’s Bench shall reside as follows: . . .

 

 

(f) one judge shall reside in the City of Campbellton, . . .

Commencement provision.
