An Act to Amend the Executive Council Act

Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:

1 Subsection 2(1) of the Executive Council Act, chapter E-12 of the Revised Statutes, 1973, is repealed and the following is substituted:

2(1) The Lieutenant-Governor may appoint, under the Great Seal of the Province, from among the members of the Executive Council the following Ministers who shall hold office during pleasure: a President of the Executive Council, an Attorney General who shall also be the Minister of Justice, a Minister of Public Safety, a Minister of Finance, a Minister of Supply and Services, a Minister of Transportation, a Minister of Natural Resources and Energy, a Minister of Agriculture, Fisheries and Aquaculture, a Minister of Health and Wellness, a Minister of Family and Community Services, a Minister of Training and Employment Development, a Minister of Education, a Minister of the Environment and Local Government, a Minister of Business New Brunswick, a Minister of Investment and Exports and a Minister of Intergovernmental Affairs.

2(1) Where in any Act, other than this Act, or in any regulation, rule, order, by-law, agreement or other instrument or document, reference is made to the Minister, Deputy Minister or Department of Agriculture and Rural Development, it shall be read, unless the context otherwise requires, as a reference to

(a) the Minister, Deputy Minister or Department of Agriculture, Fisheries and Aquaculture,

(b) the Minister, Deputy Minister or Department of Business New Brunswick,

(c) the Minister, Deputy Minister or Department of the Environment and Local Government, or

(d) the Minister, Deputy Minister or Department of Investment and Exports,

as the case may be.

2(2) Where in any Act, other than this Act, or in any regulation, rule, order, by-law, agreement or other instrument or document, reference is made to the Minister, Deputy Minister or Department of Economic Development, Tourism and Culture it shall be read, unless the context otherwise requires, as a reference to

(a) the Minister, Deputy Minister or Department of Business New Brunswick,

(b) the Minister, Deputy Minister or Department of Investment and Exports,

(c) the Minister, Deputy Minister or Department of Public Safety,

(d) the Minister, Deputy Minister or Department of Supply and Services, or

(e) the Minister responsible for the Culture and Sport Secretariat, the deputy head designated under section 3 of the Civil Service Act to be responsible for the Culture and Sport Secretariat, or the Culture and Sport Secretariat,

as the case may be.

2(3) Where in any Act, other than this Act, or in any regulation, rule, order, by-law, agreement or other instrument or document, reference is made to the Minister, Deputy Minister or Department of the Environment, it shall be read, unless the context otherwise requires, as a reference to the Minister, Deputy Minister or Department of the Environment and Local Government.

2(4) Where in any Act, other than this Act, or in any regulation, rule, order, by-law, agreement or other instrument or document, reference is made to the Minister, Deputy Minister or Department of Fisheries and Aquaculture, it shall be read, unless the context otherwise requires, as a reference to

(a) the Minister, Deputy Minister or Department of Agriculture, Fisheries and Aquaculture,

(b) the Minister, Deputy Minister or Department of Business New Brunswick,

(c) the Minister, Deputy Minister or Department of the Environment and Local Government,

(d) the Minister, Deputy Minister or Department of Health and Wellness,

(e) the Minister, Deputy Minister or Department of Investment and Exports, or

(f) the Minister, Deputy Minister or Department of Training and Employment Development,

as the case may be.

2(5) Where in any Act, other than this Act, or in any regulation, rule, order, by-law, agreement or other instrument or document, reference is made to the Minister, Deputy Minister or Department of Health and Community Services, it shall be read, unless the context otherwise requires, as a reference to

(a) the Minister, Deputy Minister or Department of Family and Community Services, or

(b) the Minister, Deputy Minister or Department of Health and Wellness,

as the case may be.

2(6) Where in any Act, other than this Act, or in any regulation, rule, order, by-law, agreement or other instrument or document, reference is made to the Minister, Deputy Minister or Department of Human Resources Development, it shall be read, unless the context otherwise requires, as a reference to

(a) the Minister, Deputy Minister or Department of Family and Community Services, or

(b) the Minister, Deputy Minister or Department of Training and Employment Development,

as the case may be.

2(7) Where in any Act, other than this Act, or in any regulation, rule, order, by-law, agreement or other instrument or document, reference is made to the Minister, Deputy Minister or Department of Intergovernmental and Aboriginal Affairs, it shall be read, unless the context otherwise requires, as a reference to the Minister, Deputy Minister or Department of Intergovernmental Affairs.

2(8) Where in any Act, other than this Act, or in any regulation, rule, order, by-law, agreement or other instrument or document, reference is made to the Minister, Deputy Minister or Department of Labour, it shall be read, unless the context otherwise requires, as a reference to

(a) the Minister, Deputy Minister or Department of Business New Brunswick,

(b) the Minister, Deputy Minister or Department of Public Safety, or

(c) the Minister, Deputy Minister or Department of Training and Employment Development,

as the case may be.

2(9) Where in any Act, other than this Act, or in any regulation, rule, order, by-law, agreement or other instrument or document, reference is made to the Minister, Deputy Minister or Department of Municipalities and Housing, it shall be read, unless the context otherwise requires, as a reference to

(a) the Minister, Deputy Minister or Department of Education,

(b) the Minister, Deputy Minister or Department of the Environment and Local Government,

(c) the Minister, Deputy Minister or Department of Finance,

(d) the Minister, Deputy Minister or Department of Public Safety, or

(e) the Minister responsible for the Culture and Sport Secretariat, the deputy head designated under section 3 of the Civil Service Act to be responsible for the Culture and Sport Secretariat, or the Culture and Sport Secretariat,

as the case may be.

2(10) Where in any Act, other than this Act, or in any regulation, rule, order, by-law, agreement or other instrument or document, reference is made to the Solicitor General, Deputy Solicitor General or the Department of the Solicitor General, it shall be read, unless the context otherwise requires, as a reference to the Minister, Deputy Minister or Department of Public Safety.

3(1) Any act or thing done from April 1, 2000 to the date of the enactment of this section, inclusive, by the Minister of Business New Brunswick, the Minister of the Environment and Local Government, the Minister of Family and Community Services, the Minister of Agriculture, Fisheries and Aquaculture, the Minister of Health and Wellness, the Minister of Investment and Exports, the Minister of Public Safety, the Minister of Training and Employment Development and the Minister responsible for the Culture and Sport Secretariat, in the exercise or performance or intended exercise or performance of any right, power, duty, function, responsibility or authority transferred to, vested in or imposed on those Ministers with respect to any Act, or any particular matter or thing under the administration, supervision or control of those Ministers

(a) shall be deemed to have been done by persons validly appointed to perform the right, power, duty, function, responsibility or authority transferred to, vested in or imposed on those Ministers,

(b) shall be deemed to constitute a valid exercise or performance of the right, power, duty, function, responsibility or authority transferred to, vested in or imposed on those Ministers, and

(c) is confirmed and ratified.

3(2) Nothing in paragraphs (1)(a) and (b) shall be taken as providing any indication that any right, power, duty, function, responsibility or authority transferred to, vested in or imposed on the Ministers referred to in subsection (1) was not validly exercised or performed by those Ministers.

4(1) The Lieutenant-Governor in Council may make the initial appointments of deputy heads under section 3 of the Civil Service Act retroactive to April 1, 2000 for the Department of Business New Brunswick, the Department of the Environment and Local Government, the Department of Family and Community Services, the Department of Agriculture, Fisheries and Aquaculture, the Department of Health and Wellness, the Department of Investment and Exports, the Department of Public Safety, the Department of Training and Employment Development, and the Culture and Sport Secretariat.

4(2) Any act or thing done on or after April 1, 2000 and before their appointment by the deputy heads appointed in accordance with subsection (1) in the exercise or performance or intended exercise or performance of any right, power, duty, function, responsibility or authority transferred to, vested in or imposed on those deputy heads,

(a) shall be deemed to have been done by persons validly appointed to perform the right, power, duty, function, responsibility or authority transferred to, vested in or imposed on those deputy heads,

(b) shall be deemed to constitute a valid exercise or performance of the right, power, duty, function, responsibility or authority transferred to, vested in or imposed on those deputy heads, and

(c) is confirmed and ratified.

4(3) Nothing in paragraphs (2)(a) and (b) shall be taken as providing any indication that any right, power, duty, function, responsibility or authority transferred to, vested in or imposed on the deputy heads appointed in accordance with subsection (1) was not validly exercised or performed by those deputy heads.

5 No action, application or any other proceeding to question or in which is questioned the validity of the appointment of the Ministers referred to in subsection 3(1) or the deputy heads appointed in accordance with subsection 4(1), or the authority of those Ministers or deputy heads to act in such capacity, shall lie or be instituted against the Crown in right of the Province or

(a) the Ministers referred to in subsection 3(1), with respect to any act or thing done from April 1, 2000 to the date of the enactment of this section, inclusive, by those Ministers in the exercise or performance or intended exercise or performance of any right, power, duty, function, responsibility or authority transferred to, vested in or imposed on those Ministers with respect to any Act, or any particular matter or thing under the administration, supervision or control of those Ministers,

(b) the deputy heads appointed in accordance with subsection 4(1), with respect to any act or thing done on or after April 1, 2000 and before their appointment by those deputy heads in the exercise or performance or intended exercise or performance of any right, power, duty, function, responsibility or authority transferred to, vested in or imposed on those deputy heads, or

(c) any other person appointed, assigned, designated or requested to assist the Ministers referred to in subsection 3(1) or the deputy heads appointed in accordance with subsection 4(1) for a limited period of time, with respect to the administration, supervision or enforcement of any Act with respect to which any right, power, duty, function, responsibility or authority that is transferred to, vested in or imposed on those Ministers, with respect to a particular matter or thing under the administration, supervision or control of those Ministers, or with respect to any right, power, duty, function, responsibility or authority that is transferred to, vested in or imposed on those deputy heads, with respect to any act or thing done within the meaning of this paragraph, by the other person,

if those Ministers, deputy heads or other persons acted in good faith in doing the act or thing.

Adult Education and Training Act

6 Section 1 of the Adult Education and Training Act, chapter A-3.001 of the Acts of New Brunswick, 1980, formerly known as the New Brunswick Community College Act, chapter N-4.01 of the Acts of New Brunswick, 1980, is amended

(a) by repealing the definition "Department" and substituting the following:

"Department" means the Department of Training and Employment Development;

(b) by repealing the definition "Minister" and substituting the following:

"Minister" means the Minister of Training and Employment Development;

Advanced Life Support Services Act

7 Section 1 of the Advanced Life Support Services Act, chapter A-3.01 of the Acts of New Brunswick, 1976, is amended by repealing the definition "Minister" and substituting the following:

"Minister" means the Minister of Health and Wellness.

Agricultural Associations Act

8 Section 1 of the Agricultural Associations Act, chapter A-5 of the Revised Statutes, 1973, is amended by repealing the definition "Minister" and substituting the following:

"Minister" means the Minister of Business New Brunswick;

9 Section 2 of New Brunswick Regulation 82-55 under the Agricultural Associations Act is repealed and the following is substituted:

"Act" means the Agricultural Associations Act.

10(1) Section 2 of New Brunswick Regulation 82-231 under the Agricultural Associations Act is repealed and the following is substituted:

10(2) Section 21 of the Regulation is amended by striking out "Deputy Minister of Agriculture and Rural Development" and substituting "Deputy Minister of Business New Brunswick".

Agricultural Commodity Price Stabilization Act

11 Section 1 of the Agricultural Commodity Price Stabilization Act, chapter A-5.01 of the Acts of New Brunswick, 1988, is amended by repealing the definition "Minister" and substituting the following:

"Minister" means the Minister of Agriculture, Fisheries and Aquaculture and includes any person designated by the Minister to act on the Ministerís behalf.

Agricultural Development Act

12 Section 1 of the Agricultural Development Act, chapter A-5.1 of the Revised Statutes, 1973, formerly known as the Farm Adjustment Act, chapter F-3 of the Revised Statutes, 1973, is amended by repealing the definition "Minister" and substituting the following:

"Minister" means the Minister of Business New Brunswick.

Agricultural Land Protection and Development Act

13(1) Section 1 of the Agricultural Land Protection and Development Act, chapter A-5.11 of the Acts of New Brunswick, 1996, is amended

(a) in the definition "local government" by striking out "Minister of Municipalities and Housing" and substituting "Minister of the Environment and Local Government";

(b) by repealing the definition "Minister" and substituting the following:

"Minister" means the Minister of Agriculture, Fisheries and Aquaculture and includes persons designated to act on behalf of the Minister;

13(2) Subsection 10(2) of the Act is amended in the portion preceding paragraph (a) by striking out "Minister of Municipalities and Housing" and substituting "Minister of the Environment and Local Government".

13(3) Section 11 of the Act is amended by striking out "Minister of Municipalities and Housing" and substituting "Minister of the Environment and Local Government".

13(4) Subsection 21(9) of the Act is amended

(a) in subsection 77.01(1) of the Community Planning Act, chapter C-12 of the Revised Statutes, 1973, as enacted by subsection 21(9), in the portion preceding paragraph (a) by striking out "Minister of Agriculture and Rural Development" and substituting "Minister of Agriculture, Fisheries and Aquaculture";

(b) in section 77.02 of the Community Planning Act, chapter C-12 of the Revised Statutes, 1973, as enacted by subsection 21(9)

(i) in subsection (1) by striking out "Minister of Agriculture and Rural Development" and substituting "Minister of Agriculture, Fisheries and Aquaculture";

Agricultural Operation Practices Act

15 Section 1 of the Agricultural Operation Practices Act, chapter A-5.3 of the Acts of New Brunswick, 1999, is amended by repealing the definition "Minister" and substituting the following:

"Minister" means the Minister of Agriculture, Fisheries and Aquaculture.

All-Terrain Vehicle Act

16 Section 1 of the All-Terrain Vehicle Act, chapter A-7.11 of the Acts of New Brunswick, 1985, is amended by repealing the definition "Minister" and substituting the following:

"Minister" means the Minister of Public Safety;

Ambulance Services Act

17(1) Section 1 of the Ambulance Services Act, chapter A-7.3 of the Acts of New Brunswick, 1990, is amended by repealing the definition "Minister" and substituting the following:

"Minister" means the Minister of Health and Wellness and includes any person designated to act on the Ministerís behalf;

17(2) Subsection 4(2) of the Act is amended

(a) by repealing paragraph (g) and substituting the following:

(g) a person employed in the Department of the Environment and Local Government,

(b) by repealing paragraph (i) and substituting the following:

(i) a person employed in the Department of Health and Wellness, who shall chair the Committee.

Anatomy Act

18 Section 1 of the Anatomy Act, chapter A-8 of the Revised Statutes, 1973, is amended by repealing the definition "Minister" and substituting the following:

"Minister" means the Minister of Health and Wellness;

Apiary Inspection Act

19 Section 1 of the Apiary Inspection Act, chapter A-9 of the Revised Statutes, 1973, is amended by repealing the definition "Minister" and substituting the following:

"Minister" means the Minister of Agriculture, Fisheries and Aquaculture.

Apprenticeship and Occupational Certification Act

20(1) Section 1 of the Apprenticeship and Occupational Certification Act, chapter A-9.1 of the Revised Statutes, 1973, formerly known as the Industrial Training and Certification Act, chapter I-7 of the Revised Statutes, 1973, is amended by repealing the definition "Minister" and substituting the following:

"Minister" means the Minister of Training and Employment Development and includes a person designated by the Minister to act on the Ministerís behalf;

20(2) Paragraph 6(1)(c) of the Act is amended by striking out "Department of Labour" and substituting "Department of Training and Employment Development".

20(3) Paragraph 7(2)(b) of the Act is amended by striking out "Department of Labour" and substituting "Department of Training and Employment Development".

21 Schedule C of New Brunswick Regulation 97-125 under the Apprenticeship and Occupational Certification Act is amended by repealing subsection 71(7) and substituting the following:

71(7) The practical examination, being the approved welderís or equivalent examination conducted by the New Brunswick Safety Code Services of the Department of Public Safety, shall be completed to the satisfaction of the New Brunswick Safety Code Services.

Aquaculture Act

22(1) Subsection 1(1) of the Aquaculture Act, chapter A-9.2 of the Acts of New Brunswick, 1988, is amended by repealing the definition "Minister" and substituting the following:

"Minister" means the Minister of Agriculture, Fisheries and Aquaculture and includes persons designated by the Minister to act on the Ministerís behalf;

22(2) Section 38 of the Act is amended by striking out "Department of Fisheries and Aquaculture" and substituting "Department of Agriculture, Fisheries and Aquaculture".

23 Paragraph 24(5)(a) of New Brunswick Regulation 91-158 under the Aquaculture Act is amended by striking out "Department of Fisheries and Aquaculture" and substituting "Department of Agriculture, Fisheries and Aquaculture".

Arts Development Trust Fund Act

24(1) Section 3 of the Arts Development Trust Fund Act, chapter A-13.1 of the Acts of New Brunswick, 1990, is amended in the portion preceding paragraph (a) by striking out "Minister of Economic Development, Tourism and Culture" and substituting "Minister responsible for the Culture and Sport Secretariat".

24(2) Section 4 of the Act is amended

(a) in subsection (1) by striking out "Minister of Economic Development, Tourism and Culture" and substituting "Minister responsible for the Culture and Sport Secretariat";

(b) in subsection (2) by striking out "Minister of Economic Development, Tourism and Culture" and substituting "Minister responsible for the Culture and Sport Secretariat".

Assessment Act

25 Subparagraph 29(1.2)(a)(ii) of the Assessment Act, chapter A-14 of the Revised Statutes, 1973, is amended by striking out "Minister of Municipalities and Housing" and substituting "Minister of the Environment and Local Government".

Beaverbrook Art Gallery Act

26 Subparagraph 5(2)(a)(ii.1) of the Beaverbrook Art Gallery Act, chapter B-1 of the Revised Statutes, 1973, is repealed and the following is substituted:

(ii.1) the Minister responsible for the Culture and Sport Secretariat;

Beverage Containers Act

27 Section 1 of the Beverage Containers Act, chapter B-2.2 of the Acts of New Brunswick, 1991, is amended by repealing the definition "Minister" and substituting the following:

"Minister" means the Minister of the Environment and Local Government and includes persons designated by the Minister to act on the Ministerís behalf;

Boiler and Pressure Vessel Act

28 Section 1 of the Boiler and Pressure Vessel Act, chapter B-7.1 of the Acts of New Brunswick, 1976, is amended by repealing the definition "Minister" and substituting the following:

"Minister" means the Minister of Public Safety and includes a person designated by the Minister under section 3 to act on the Ministerís behalf;

29 Section 201 of New Brunswick Regulation 84-174 under the Boiler and Pressure Vessel Act is amended by repealing the definition "Department" and substituting the following:

"Department" means the Department of Public Safety;

30 Section 2 of New Brunswick Regulation 84-176 under the Boiler and Pressure Vessel Act is amended by repealing the definition "Department" and substituting the following:

"Department" means the Department of Public Safety;

Business Improvement Areas Act

31 Subsection 1(1) of the Business Improvement Areas Act, chapter B-10.2 of the Acts of New Brunswick, 1985, is amended by repealing the definition "Minister" and substituting the following:

"Minister" means the Minister of the Environment and Local Government;

Cemetery Companies Act

32(1) Section 1 of the Cemetery Companies Act, chapter C-1 of the Revised Statutes, 1973, is amended by repealing the definition "Minister" and substituting the following:

"Minister" means the Minister of Health and Wellness;

32(2) Paragraph 5(1)(b) of the Act is amended by striking out "Minister of Municipalities and Housing" and substituting "Minister of the Environment and Local Government".

32(3) Section 40 of the Act is amended by striking out "Department of Health and Community Services" and substituting "Department of Health and Wellness".

33(1) Section 12 of New Brunswick Regulation 94-129 under the Cemetery Companies Act is amended

(a) in subparagraph (4)(b)(v) by striking out "Minister of Municipalities and Housing" and substituting "Minister of the Environment and Local Government";

(b) in subparagraph (5)(b)(v) by striking out "Minister of Municipalities and Housing" and substituting "Minister of the Environment and Local Government".

33(2) Subparagraph 13(3)(b)(v) of the Regulation is amended by striking out "Minister of Municipalities and Housing" and substituting "Minister of the Environment and Local Government".

Change of Name Act

34 Section 5 of the Change of Name Act, chapter C-2.001 of the Acts of New Brunswick, 1987, is amended

(a) in paragraph (1)(b) by striking out "Minister of Health and Community Services" and substituting "Minister of Family and Community Services";

151(2) Paragraph 2(b) of the Act is amended by striking out "Department of Health and Community Services" and substituting "Department of Health and Wellness".

151(3) Subparagraph 4(b)(ii) of the Act is repealed and the following is substituted:

(ii) the actual growth rate in gross ordinary account expenditures of the Department of Health and Wellness in a fiscal year, as determined by comparing the gross ordinary account expenditures of the Department of Health and Wellness for that fiscal year with the gross ordinary account expenditures of the Department of Health and Community Services for the previous fiscal year or the gross ordinary account expenditures of the Department of Health and Wellness for the previous fiscal year, as the case may be.

Effect of reorganization

21 If a patient who is an indigent person, or the dependant of an indigent person, dies in a hospital facility, the Minister of Family and Community Services shall pay to the hospital corporation, in accordance with the regulations, any expenses of burial incurred by the hospital corporation.

Workersí Compensation Act

286(1) Section 83.1 of the Workersí Compensation Act, chapter W-13 of the Revised Statutes, 1973, is amended

(a) in subsection (1) by striking out "Department of Labour" and substituting "Department of Training and Employment Development";

(b) in subsection (3) by striking out "Department of Labour" and substituting "Department of Training and Employment Development".

286(2) Section 83.2 of the Act is amended

(a) in subsection (1) by striking out "Department of Labour" and substituting "Department of Training and Employment Development";

(b) in subsection (3) by striking out "Department of Labour" and substituting "Department of Training and Employment Development".

Workplace Health, Safety and Compensation Commission Act

287 Section 1 of the Workplace Health, Safety and Compensation Commission Act, chapter W-14 of the Acts of New Brunswick, 1994, is amended by repealing the definition "Minister" and substituting the following:

"Minister" means the Minister of Training and Employment Development.

Youth Assistance Act

288(1) Subsection 10(1) of the Youth Assistance Act, chapter Y-2 of the Acts of New Brunswick, 1984, is amended by striking out "Minister of Economic Development, Tourism and Culture" and substituting "Minister of Business New Brunswick".

288(2) Subsection 11(1) of the Act is amended by striking out "Minister of Municipalities and Housing" and substituting "Minister responsible for the Culture and Sport Secretariat".

289 This Act shall be deemed to have come into force on April 1, 2000.

EXPLANATORY NOTES

Section 1

A number of changes are made to subsection 2(1) of the Executive Council Act which authorizes the appointment of Ministers from among members of the Executive Council.
