An Act to Amend the Endangered Species Act
Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:
1 Section 4 of the Endangered Species Act, chapter E-9.101 of the Acts of New Brunswick, 1996, is amended
(a) by repealing paragraph (1)(b) and substituting the following:
(b) subject to such terms and conditions as the Minister considers appropriate, issue a permit
(i) for the collection or possession, or both, of a member or any part of a member of an endangered species or regionally endangered species
(A) for scientific purposes relating to the recovery of the endangered species or regionally endangered species,
(B) for bona fide educational purposes, or
(C) in the case of bald eagle feathers, for bona fide religious or ceremonial purposes, or
(ii) for the possession of a member or any part of a member of an endangered species or regionally endangered species that was legally obtained for any bona fide purpose by the applicant for the permit before its designation by regulation as endangered or regionally endangered.
(b) by adding after subsection (1) the following:
4(1.1) Subparagraph (1)(b)(ii) applies regardless of whether a designation referred to in that subparagraph was made before or is made after the commencement of that subparagraph.
