An Act to Amend the Private Occupational Training Act

Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:

1 Section 1 of the Private Occupational Training Act, chapter P-16.1 of the Revised Statutes, 1973, is amended by adding the following definition in alphabetical order:

"equivalent training" means training in the same trade and to the same level of qualification as the training a student was to have received in an occupational training program;

2 Section 3 of the Act is amended by adding after subsection (2) the following:

3(3) A person may act as a training assistant of an occupational training program without being registered under this Act if the training organization is registered under this Act.

3 Section 6.1 of the French version of the Act is amended by striking out "d)" and substituting "c)".

4 Section 6.4 of the Act is amended

(a) by repealing paragraph (5)(a) and substituting the following:

(a) to provide compensation to a student, or a third party who has paid tuition fees on behalf of a student, if a training organization fails to provide, to completion, the occupational training program for which the tuition fees have been paid,

(b) in subsection (7)

(i) by repealing paragraph (a) and substituting the following:

(a) pay for the student to complete equivalent training with another training organization, or

(ii) by repealing subparagraph (b)(i) and substituting the following:

(i) the tuition fees for the last academic year for which tuition fees were paid, and

5 Subsection 6.6(2) of the Act is amended in the portion preceding paragraph (a) by striking out "ten" and substituting "fifteen".

6 Subsection 7(1) of the Act is amended in the portion preceding paragraph (a) by striking out "during normal business hours" and substituting "at any reasonable time".

7 Section 11 of the Act is amended by adding after paragraph (s) the following:

(s.1) defining training assistant for the purposes of subsection 3(3);
