An Act to Amend the Community Planning Act

Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:

1 Section 1 of the Community Planning Act, chapter C-12 of the Revised Statutes, 1973, is amended by adding after the definition "council" the following:

"credit union" means a credit union as defined under the Credit Unions Act;

2 Subsection 7(5) of the Act is repealed and the following is substituted:

7(5) Any funds received by a commission are to be deposited to its credit in a chartered bank, credit union or such other institution as the Minister approves.

3 Paragraph 44(1)g) of the French version of the Act is repealed and the following is substituted:

g) doit, quand il reçoit un plan provisoire qui comporte le tracé de rues publiques ou futures ou la réservation de terrains d'utilité publique ou qui peut influer, à son avis, sur le futur emplacement des rues publiques, transmettre une copie du plan au conseil ou au ministre des Transports, et au comité consultatif ou à la commission, suivant que la présente loi leur confère le pouvoir de donner leur assentiment à un plan de lotissement ou de faire des recommandations à ce sujet;

4 Section 77 of the Act is amended

(a) in paragraph (1)(g.01) by striking out "the fees for the application and such permits" and substituting "the fees for the application and such permits, the fees for building inspection services";

(b) by adding after subsection (1) the following:

77(0.1) Where a fee is prescribed under paragraph (1)(g.01), the fee shall be paid, notwithstanding the Financial Administration Act, to the commission and shall be credited to the cost of the delivery of the land use planning service under subsection 27.2(2) of the Municipalities Act.

(c) in paragraph (7)(a.1) by striking out "the Minister of Transportation" and substituting "a commission";

(d) in clause (8)a)(ii)(B) of the French version by striking out "approuvé ou signé" and substituting "approuvé et signé";

(e) in subsection (11)

(i) in paragraph (b) by striking out "(1) or";

(ii) by repealing paragraph (c) and substituting the following:

(c) follow, with the necessary modifications, the procedure preliminary to the enactment of a by-law under sections 67 and 68, except if the regulation is to be made under paragraph (1)(a), (b), (f), (g),(g.01) or (h).

5 This Act or any provision of it comes into force on a day or days to be fixed by proclamation.
