Legislation

The two Acts in New Brunswick which fall within the mandate of the Office of the Conflict of Interest Commissioner are the Members’ Conflict of Interest Act and the Public Interest Disclosure Act.

The Members’ Conflict of Interest Act applies to:

  • Members and former Members of the Legislative Assembly, and
  • members and former members of the Executive Council.

Under the Public Interest Disclosure Act, where an employee reasonably believes that he or she has information that could show that a wrongdoing has been committed or is about to be committed, the employee may make a disclosure to:

  • the employee’s supervisor,
  • the employee’s designated officer, or
  • the Commissioner

Only the Commissioner may receive a claim of wrongdoing that has been made anonymously or by a person who is not an employee.
