Change of sex designation

If you are 16 or older, you may apply to have a change of sex designation on your birth certificate. A parent who has care and custody of a child, 15 or younger, may apply for a change of sex designation on their child’s birth certificate. 

To change your sex designation on a birth certificate, you must have been born in New Brunswick or have resided in the province for at least three months prior to making an application.

Applicants must provide a written statement stating they have assumed, identify with and intend to maintain the gender identity that corresponds with the change requested. Additionally, a written statement is required from a health professional who affirms the sex shown on the applicant’s birth certificate does not correspond with the applicant’s gender identity.

If the child is 15 or younger, written consent of every parent is required. If written consent cannot be obtained for the application, proof of notification to all other parents and of their right to object to the change of sex designation must be provided. Children between 12 and15 must also provide written and witnessed consent to the application including a statement indicating they have assumed, identify with and intend to maintain the gender identity that corresponds with the change requested. Additionally, a written statement from a health professional is required.
