Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:
1 The Human Rights Act chapter H-11 of the Revised Statutes, 1973, is amended by adding after subsection 10(4) the following:
10(4.1) No fewer than one hundred and twenty days prior to the making of any appointment, the Lieutenant-Governor in Council shall cause to be published public notice of the intention to make appointments and shall invite applications from qualified members of the public.
10(4.2) In appointing members to or designating the Chair of the Commission, the Lieutenant-Governor in Council shall give preference to candidates who meet the following criteria:
(a) demonstrate evidence of past experience in the field of adjudicating or defining human rights,
(b) possess past experience in promoting and furthering human rights, and
(c) possess the needed management and administrative skills necessary to carry out their duties.
10(4.3) In making an appointment, the Lieutenant-Governor in Council shall also consider the composition of the Commission in terms of regional representation, gender balance and representation of different sectors directly affected by the Act.
10(4.4) In announcing any appointments, the Lieutenant-Governor in Council shall cause to be published in writing, an explanation of the qualifications of each appointee based upon the criteria and considerations enumerated in subsections (4.2) and (4.3).
