An Act to Amend the Liquor Control Act
Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:
1 The Liquor Control Act, chapter L-10 of the Revised Statutes, 1973, is amended by adding after section 42 the following:
42.1 Notwithstanding any other provision of this Act, no dining-room licensee, lounge licensee, special facility licensee, special events licensee, club licensee, other than a club licensee under section 110, or in-house brewery licensee, and no employee or agent of any such licensee, shall make, or offer to make, a gift of liquor or give liquor to any person on the licensed premises and where applicable, on premises to which a licence extension under section 63.02 relates or in an area adjacent to and outside of a dining-room, lounge or special facility.
2 The Act is amended by adding after section 135 the following:
135.1 No licensee and no employee or agent of a licensee shall sell or offer to sell liquor at a price that is less than the price determined in accordance with the regulations.
3 Subsection 200(1) of the Act is amended by adding after paragraph (b) the following:
(b.1) respecting the price of liquor for the purposes of section 135.1;
4 This Act or any provision of it comes into force on a day or days to be fixed by proclamation.
The new provision imposes restrictions on gifts of liquor made by certain licensees.
The new provision prohibits the sale or offering for sale of liquor below the price determined in accordance with the regulations.
Regulation-making authority is added.
